shall assign, transfer, or make over said bill, bond, promis-
sory note, or other evidence of debt, liable and chargeable
.under the provisions of this Act, to be assessed with a view and
purpose of avoiding the assessment and payment of any tax,
which may be chargeable and payable thereon under the
provisions of this Act, the maker of said bill, bond or
promissory note or other evidence of debt, or any security or
endorser thereon, may plead the same in any suit brought
for the recovery of the debt, on such bill, bond promissory
note, or other evidence of debt, and said plea, if found to
be true by the Court or jury before which the said suit may-
be pending, shall be a bar to any recovery by the plaintiff,
whether said plaintiff be the original holder or assignee, or
endorser of said bill, bond, promissory note or other evidence
of debt; provided, the said Court or jury as the case may be,

shall find from this evidence that the plaintiff was party
and privy to the assignment, endorsement or transfer, made
and done as aforesaid."
