any such pass or permit for free travel or transportation,
during or for the time for which he may have been elected or
appointed, shall be taken and regarded as a violation of the
provisions of these resolutions, and as a virtual resignation
or declension of his official position, whereupon his place
shall be declared vacant as if caused by death, resignation or
otherwise, and such vacancy shall at once be filled according
to law.

Which were read the first time.
On motion by Mr. Walsh,

The Senate at 1.40 P. M., proceeded to the consideration
of Executive business.

On motion by Mr. Walsh,

The Senate, at 2.10 P. M , resumed the consideration of
legislative business.

At 2.15 P. M., the Senate adjourned.

WEDNESDAY, January 12th, 1876.

Senate met at 10 A. M.

Prayer by Rev. Mr. Canter.

Present at the roll call the following Senators :

Messrs. President, Aydelotte, Bannon, Brewer, Cooper,
Duke, Dennis, Freeman, Ford, Getty, Gorman, Hepbron,
Humphreys, Joyce, Knight, Lee, Lawrence, Lloyd, McCul-
loh, Mudd, Newcomer, Phelps, Stevens, Steiner, Suit,
Walsh—26,

Journal of yesterday read and approved.
On motion by Mr. Aydelotte, it was

Ordered, That Rowland E. Bivens, an officer of this Senate,
have leave of absence for a few days, on and after Friday
next, to obey a summons from the Circuit Court of Worces-
ter county, to return as soon as his duties to said Court will
permit.

On motion by Mr. Dennis,

Leave was granted to Messrs. Dennis, Humphreys and Ayde-
lotte to report a bill to amend Chapter 218 of 1856, entitled
