Justice of the Peace available nearest to the place of arrest
where used herein shall be construed to mean such Justice of
the Peace as resides nearest the place of arrest and who is at
home or at an office in the same vicinity, but where the arrest-
ing person knows that the Justice of the Peace nearest the
place of arrest is not at home or at an office in the same
vicinity or is by reason of any circumstance unable to hear
the charge preferred against the arrested person, then the
arresting person shall take the arrested person to the Justice
of the Peace next available and next nearest the place of
arrest. In the event any person shall take into custody or
arrest any person charged with violation of any law, regula-
tion or ordinance as above enumerated and such arresting
person shall fail to take such arrested person before a Justice
of the Peace available nearest to the place of arrest as herein
provided, such person making the arrest shall be guilty of a
violation of this section and shall be subject to a fine of not
less than Ten Dollars ($10. 00) or more than One Hundred
Dollars ($100. 00), and each violation of the provisions hereof
shall constitute a separate offense, and if any of such arresting
persons violating this section shall be a member of the Prince
George's County Police Force he shall, in addition to the
penalty directed herein, be subject to suspension from duty
for not more than ten (10) days without pay.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon a yea and nay vote supported by three-fifths
of all of the members elected to each of the two Houses of the
General Assembly of Maryland, the same shall take effect from
the date of its passage.

CHAPTER 472.

AN ACT to repeal and re-enact, with amendments, Sections
700 and 701 of Article 17 of the Code of Public Local Laws
of Maryland (1930 Edition), title "Prince George's County",
sub-title "Licenses", to reduce the fee and licenses for hawk-
ers and peddlers and to provide for the licensing of hawkers
and peddlers, and to provide for licensing of road-side
stands.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 700 and 701 of Article 17 of the Code of
