stitutional, the said section, sentence, clause or part thereof
shall be deemed and taken to be severable from the balance of
said Act and all the balance of said section, sentence, clause
or parts of sections and all the balance of said Act shall be
and remain as a valid and subsisting Act.

SEC. 6. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed upon a yea and nay vote, supported by three-fifths
(3/5ths) of all of the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.

CHAPTER 540.

AN ACT to add a new section to Article 89B of the Annotated
Code of Maryland (1935 Supplement), title "State Roads",
said new section to be known as Section 7AC, and to follow
immediately after Section 7AB of said Article, authorizing
and directing the State Roads Commission to pay certain
sums of money to the incorporated towns of Frederick
County from the portion of the "One and One-half Cent
Lateral, County and Municipal Road Gasoline Fund" allo-
cated to Frederick County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
89B of the Annotated Code of Maryland (1935 Supplement),
title "State Roads", said new section to be known as Section
7AC, to follow immediately after Section 7AB of said Article,
and to read as follows:

7AC. The State Roads Commission of Maryland is hereby
authorized and directed to pay out of the funds allocated to
Frederick County by said Commission from the "One and One-
half Cent Lateral, County and Municipal Road Gasoline Fund"
the following amounts to the incorporated towns of Frederick
County, the sum of Five Thousand Dollars ($5, 000. 00) to
Frederick City, the sum of Two Thousand Dollars ($2, 000. 00)
to each of the remaining incorporated towns of Frederick
County operating under its Charter, the said fund to be ex-
pended for street construction, reconstruction and repairs,
with preference to be given to such streets as connect up with
State or County roads; provided, however, that the State
