lieving the Clerk of the necessity of giving bond, be and the
same are hereby repealed and re-enacted with amendments and
additions, to read as follows:
102. The government of said town shall be vested in five
Commissioners to be selected as hereinafter provided, who shall
be taxpayers and qualified voters of the town at least twelve
months next preceding their election. At the election to be
held on the first Saturday in December, 1938, the three elected
Commissioners receiving the highest number of votes for said
office shall hold office for a term of four years, and the two
elected Commissioners receiving the lowest number of votes
for said office shall hold office for a term of two years, or until
their successors are appointed or elected and qualified.
163. No one, except as hereinafter provided, shall be entitled
to become a candidate for the office of Commissioner, unless
he, or someone on his behalf, shall, at least thirty days prior
to any election at which he intends to become a candidate, file
with the Clerk to the Commissioners a written statement
signed by the candidate and witnessed by at least one person,
to the effect that he thereby becomes a candidate for office of.
Commissioner. Provided, however, that if no candidate or less
than five candidates have filed prior to thirty days before
election as aforesaid, then in such event the Commissioners
shall and they are hereby required to extend the time limit for
filing to some date prior to election that will, in their discre-
tion, permit there being at least five candidates for the office
of Commissioners. The citizens of Sharptown, who have re-
sided within the corporate limits of said town for at least
twelve months next preceding the election and who were quali-
fied voters at the last preceding State or Congressional elec-
tion, shall on the first Saturday in December, 1938, elect by
ballot five persons to be Commissioners to hold office for the
terms as hereinbefore set forth in this Act. On the first Satur-
day in December, 1940, there shall be elected two Commis-
sioners to replace those whose terms will then have expired,
and the two Commissioners then elected shall hold office for a
term of four years. Beginning with the election, to be held
on the first Saturday in December, 1940, elections shall be held
every two years thereafter and the terms of all Commissioners
elected shall be four years, or until their successors are ap-
pointed or elected and qualified. Said Commissioners before
they enter upon the duties of their office shall make oath before
a Justice of the Peace or Notary Public of Wicomico County,
State of Maryland, that they will diligently and faithfully
without partiality, favor or prejudice, well and truly perform
the duties of Commissioners of said town; and said Commis-
