(2) The County Commissioners are authorized to bor-
row against the anticipated proceeds to be derived from
Section 73 of Article 2B of the Annotated Code of Mary-
land (1943 Supplement), and to issue notes and to pledge
the same. The proceeds of such loans shall be used in
accordance with the provisions of Sub-section (1) of this
section. Such loans shall be made for a period not exceed-
ing one year and at a rate of interest not exceeding three
percent. (3%).

SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency measure and necessary
for the immediate preservation of the public health and
safety, and having been passed by a yea and nay vote,
supported by three-fifths of all of the members elected to
each of the two Houses of the General Assembly, the same
shall take effect from the date of its passage.

CHAPTER 59.
(House Bill 3)

AN ACT to repeal and re-enact, with amendments, Section
54 (a) of Article 33 of the Annotated Code of Maryland (1939
Edition), title "Elections", sub-title "Nominations and
Primaries", as said Article was enacted by Chapter 934 of
the Acts of 1945, relative to the time within which a candi-
date may petition for a recount.

SECTION I. Be it enacted by the General Assembly of Mary-
land, That Section 54(a) of Article 33 of the Annotated Code
of Maryland (1939 Edition), title "Elections", sub-title "Nomi-
nations and Primaries", as enacted by Chapter 934 of the Acts
of 1945, be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

54, (a) Within ten days after the day of any pri-
mary election any candidate for a nomination or for delegate
to any convention or for executive or member of any committee
or position who has been defeated on the face of the returns
may petition the Supervisors of Elections of Baltimore City
