CHAPTER 234.
(House Bill 237)

AN ACT to repeal and re-enact, with amendments, Sections
22, 23, 24 and 25 of Article 3 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Baltimore County",
sub-title "Auctioneers", to prescribe a uniform license fee
for auctioneers in Baltimore County, the conditions upon
issuance of a license, including posting of a bond, the penal-
ties for non-compliance, and in general to clarify and
modernize the laws relating to auctioneers' licenses in Balti-
more County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 22, 23, 24 and 25 of Article 3 of the Code
of Public Local Laws of Maryland (1930 Edition), title "Balti-
more County", sub-title "Auctioneers", be and the same are
hereby repealed and re-enacted, with amendments, to read as
follows:

22. No person shall act as an auctioneer in Baltimore
County unless he shall have first taken out a license as here-
inafter provided.

23. It shall be the duty of the Clerk of the Circuit Court of
said county to issue auctioneer licenses to such persons as
may apply for and be entitled to them under this sub-title, and
according to the conditions and provisions of this sub-title,
the amount so received from said licenses to be paid to the
Board of Education of Baltimore County, to be credited by
them to the school fund of said county.

24. The annual license fee shall be Fifty Dollars ($50.00),
accounting from June 1, 1947, and June 1st, in each year
thereafter, and there shall be no pro-rating or rebating of said
license fee. The application for such license shall state the
name, age and permanent business and residence addresses
of the applicant. No license shall be issued until the appli-
cant, after complying with the aforegoing, has also filed with
the Clerk of the Circuit Court for Baltimore County, his bond
in the amount of $5,000.00, to the County Commissioners of
Baltimore County, for the use and benefit of any person, firm
or corporation dealing with him as auctioneer and conditioned
upon his proper accounting, payment and delivery of any
monies or property entrusted to his care and possession while
acting as an auctioneer. Said bond shall also be executed by
a corporate surety licensed by the Insurance Commissioner
of the S'tate of Maryland to do business.
