SEC. 3. And be it further enacted, That upon the sale of
said bonds, or any part thereof, the proceeds thereof shall
he used by the Mayor and Councilmen of Frostburg for the
general repair of the streets, roads and alleys of said City
and for no other purpose or purposes.

SEC. 4. And be it further enacted, That the full faith,
credit and resources of said City shall be pledged for the
payment of said bonds and the interest thereon as the same
respectively mature and for the purpose of paying such in-
terest as it falls due and also for the purpose of paying and
discharging the principal of said bonds at maturity, the
said Mayor and Councilmen of Frostburg shall levy a tax
upon, all of the assessable property in said City in .each of
the years while the said bonds, or any of them are outstand-
ing, sufficient for that purpose.

SEC. 5. And be it further enacted, That the bonds here-
under authorized shall be issued in addition to and exclusive
of the 7 per cent bonded indebtedness on the assessed valua-
tion of property in the City of Frostburg authorized by Sec-
tion 145 of Chapter 31 of the Acts of the General Assembly
of Maryland of 1922, and that any and all Acts or parts of
Acts, or any part or parts of the Charter of the City of Frost-
burg conflicting in any way herewith, is or are repealed inso-
far and to the extent that the same shall so conflict, and
none of the limitations or restrictions on the power of the
Mayor and Councilmen of Frostburg to borrow money or
issue and sell bonds contained in the Charter of said City,
or in any other law which limits, restricts or in any way
affects the power herein granted, nor any of the provisions
of Sections 34 to 36 of Article 31 of the Annotated Code
(1939 Edition), as amended by Chapter 532 of the Acts of
1945, shall be applicable thereto.

SEC. 6. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly of Maryland, the same shall take effect
from the date of its passage.
