the Council and all valid actions of the Citizens' Committee
and of the Secretary-Treasurer performed under the provisions
of Chapter 419 of the Acts of the General Assembly of Mary-
land, Session of 1931, and not inconsistent with the provisions
of this Act, shall be, and hereby are, declared to remain in full
force and effect unless and until properly modified or rescinded
in accordance with the provisions of this Act. No provisions
of the Act shall affect any right, lien, or liability subsisting at
the date of its passage.
(B) On the second Tuesday in April, 1947, and on the
second Tuesday in April of each succeeding year, an election
shall be held at which Councilmen and a Secretary-Treasurer
shall be elected to fill any vacancies which may have occurred
during the previous year; provided, however, that Councilmen
elected to fill vacancies shall be elected only to serve for the
remainder of the unexpired term. Elections shall be by ballot
in a manner to be prescribed by the Council. Only resident
real property owners of legal age or registered and qualified
voters of Montgomery County residing in Chevy Chase View
shall be entitled to vote.
(C) Following each election each newly elected official shall
qualify within ten days by taking oath, before any officer in
Montgomery County authorized by law to administer oaths,
to discharge diligently and faithfully all duties of the office.
(D) If any newly elected official fails to so qualify, or if any
Councilman or Secretary-Treasurer shall remove his residence
from Chevy Chase View, his office shall be deemed to have
become vacant. Vacancies in the Council or in the office of
Secretary-Treasurer which occur more than thirty days be-
fore the annual election may be filled by appointment, ap-
proved by a majority of the Council, of a resident real property
owner of legal age or a registered and qualified voter of Mont-
gomery County residing in Chevy Chase View to serve, upon
qualification as required of a newly elected official, until the
next regular election.
120. (A) The County Commissioners are hereby authorized,
empowered and directed to levy and cause to be collected from
the owners of real property in Chevy Chase View at the time
of the county tax levy for the tax year beginning July 1, 1947,
and for each tax year thereafter, a tax on the assessed valua-
tion of the real properties in Chevy Chase View, in amounts
certified to the County Commissioners by the Council: Pro-
vided, however, that the Council shall not certify nor the
County Commissioners levy or collect a tax for any year in
excess of thirty-four cents ($0.34) on each One Hundred Dol-
lars ($100.00) of assessed valuation of such real property.
