2116 LAWS OF MARYLAND. [CH. 890

795. Whenever any member of the Montgomery County
Police has served on the Montgomery County Police Force
for twenty-five (25) years, or shall have become incapacitated
either by accident, disease or disability contracted in the line
of duty so as to be unable to perform his duties and shall
make written application to the Police Trial Board of Mont-
gomery County and on the approval of said Police Trial
Board of Montgomery County, he shall in either event be
retired from the service thereof and be entitled to receive
relief from the said Police Fund in an amount of fifty per
centum per year of the salary received by him at the date of
retirement. In case of the death of any member of the Police
Department before or after retirement from the service
thereof, leaving a widow, or a child or children under eighteen
years of age, the widow shall be entitled to receive relief
from the said Police Fund, in an amount not exceeding Sixty
($60.00) Dollars per month, and each child under the age
of eighteen years in an amount not exceeding Ten ($ 10.00)
Dollars per month; provided, that upon remarriage of any
widow granted relief under the provisions of this sub-title
such relief shall cease, and relief granted to or for any child
or children under the age of eighteen years shall cease upon
their reaching that age; provided, further, that no widow,
child or children of any deceased member of the said Police
Force resulting from any marriage contracted subsequent
to the date of retirement of such member shall be entitled
to any relief under the provisions of this sub-title.

Whenever any member of the Montgomery County Police,
having served not less than five years, shall have become in-
capacitated either by accident, disease or diability contracted
not in line of duty so as to be unable to perform his duties and
shall make written application therefor and said application
shall be approved by the Police Trial Board of said Mont-
gomery County he shall be retired from the service thereof
and be entitled to receive relief from the said Police Relief
and Retirement Fund in an amount to be determined as
follows: If he shall have served more than five years but
less than six years on said Police Force prior to being in-
capacitated he shall receive compensation amounting to ten
per centum per year of the salary received by him at the date
of retirement and for each additional year he shall have
served on said Police Force prior to incapacitation he shall
receive an additional two per centum per year of the salary
received by him at the date of retirement but in no case shall
any member of said Police Force who is retired under the
provisions of this section receive compensation in excess of
fifty per centum of his annual salary at the date of retire-
ment.
