CHAPTER 855.

(House Bill 798)

AN ACT to repeal Sub-section (Montgomery County) of Sec-
tion 100 of Article 52 of the Annotated Code of Maryland
(1943 Supplement), title "Justices of the Peace", sub-title
"Trial Magistrates System", and to enact in lieu thereof a
new sub-section to be known as Sub-section (Montgomery
County), to follow immediately after Sub-section (Kent
County), of said Article, relating to the number and salaries
of Trial Magistrates and empowering them to substitute
each for the other in Montgomery County, and relating to
the appointment of Clerks and additional deputy sheriffs
and to their duties and compensation.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sub-section (Montgomery County) of Section 100
of Article 52 of the Annotated Code of Maryland (1943 Sup-
plement), title "Justices of the Peace", sub-title "Trial Magis-
trates System", be and it is hereby repealed and that a new
Sub-section (Montgomery County), be and it is hereby en-
acted in lieu thereof, to follow immediately after Sub-section
(Kent County), and to read as follows:

100. (Montgomery County.) There shall be three Trial
Magistrates each of whom shall receive an annual salary of
$3,000.00. One of said magistrates shall be designated as
Trial Magistrate at Rockville and shall sit at Rockville; one
of said magistrates shall be designated as Trial Magistrate at
Bethesda and shall sit at Bethesda; and one of said magis-
trates shall be designated as Trial Magistrate at Silver Spring
and Takoma Park and shall sit at Silver Spring and shall
also sit at Takoma Park not less than one day or part thereof
in each week.

In the event of the absence, illness or disqualification for
any reason of a Trial Magistrate so designated to sit at one
of said places, one of the other two trial magistrates shall
be designated by one of the judges of the Circuit Court of
Montgomery County to substitute for and sit for said absent, ill
or disqualified magistrate at the place having been designated
for the absent, ill or disqualified magistrate to sit, and the
substituting magistrate shall then and there try and pass
sentence or judgment in all cases civil or criminal, the same
as the absent, ill or disqualified magistrate could have done
were he present. The Sheriff of Montgomery County, Chief
Deputy, and all other deputies are hereby authorized, directed
