of the Upper Montgomery County Volunteer Fire Depart
ment, Inc., to borrow not exceeding $35,000 and issue
bonds therefor and to provide for the payment thereof.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That sixteen new sections be and they are hereby added
to Article 16 of the Code of Public Local Laws of Maryland
(1939 Edition), title "Montgomery County", sub-title "Fire
Companies", to be under a new sub-heading "Upper Mont-
gomery County Volunteer Fire Department", said new sec-
tions to be known as Sections 335A to 335P, inclusive, and
to follow immediately after Section 335 of said Article, and
to read as follows:
UPPER MONTGOMERY COUNTY VOLUNTEER FIRE DEPARTMENT
335A. For the purpose of providing funds with which to
equip, operate and maintain a fire department, within the
area designated and known as the Third and Eleventh Elec-
tion Districts as now constituted, of Montgomery County,
the Board of County Commissioners of Montgomery County
are hereby authorized, empowered and directed to levy an-
nually against all the assessable real and personal property
within the said Third and Eleventh Election Districts of
Montgomery County a tax sufficient, but not to exceed ten
cents (10c) on each One Hundred Dollars ($100) of real
and personal property, to pay all or any part of the require-
ments of expenditures to purchase and build a fire depart-
ment building and to operate said fire department now known
as the Upper Montgomery County Volunteer Fire Depart-
ment, Incorporated, of Montgomery County, and to purchase
equipment from time to time for the said fire department
including payment on encumbrances on the real estate or
equipment of the said fire department.
335B. The said tax shall be determined, levied, collected
and paid in the following manner: At least thirty (30) days
before the tax levying period of each year, the County Com-
missioners of the said County shall certify to the Upper
Montgomery County Volunteer Fire Department, Inc., of
Montgomery County, the whole valuation of the assessable
property within the said Third and Eleventh Election Dis-
tricts, and the Fire Board of the Upper Montgomery County
Volunteer Fire Department, Inc., hereinafter created, shall
then determine the amount necessary to be raised for the
ensuing year to pay all or any part of the above authorized
expenditures and so certify to the Board of County Com-
