SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1947.

CHAPTER 796.
(House Bill 602)

AN ACT to add a new sub-section to Section 21 of Article
99 of the Annotated Code of Maryland (1943 Supplement),
title "Birds, Game, and Inland Water Fish", sub-title
"Upland and Migratory Game Birds and Game Animals",
said new sub-section to be known as Sub-section (k) and
to follow immediately after Sub-section (j) of said Section
21; and to repeal and re-enact, with amendments, Section
36 of said Article 99, sub-title "Field Trials", as said Sec-
tion 36 was amended by Chapter 332 of the Acts of 1945
relating to molesting game in any den and to the penalties
for illegal hunting.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
99 of the Annotated Code of Maryland (1943 Supplement),
title "Birds, Game, and Inland Water Fish", sub-title "Up-
land Migratory Game Birds and Game Animals", said new
sub-section to be known as Sub-section (k) and to follow
immediately after Sub-section (j) of said Section 21; and that
Section 36 of said Article 99, sub-title "Field Trials", as said
Section 36 was amended by Chapter 332, be and the same is
hereby repealed and re-enacted, with amendments, all to read
as follows:

21. (k) It shall be unlawful to smoke, burn, or otherwise
molest game in any den or to damage or destroy the den of
any protected game species. It shall be unlawful to injure,
take or kill any game which has taken refuge in any den.

36. (Penalties.) Any person, convicted before any Justice
of the Peace of this State, or Court of Justice, for violating
any of the provisions of Sections 21 to 35, inclusive, unless a
different penalty is otherwise provided in the section, shall be
guilty of a misdemeanor and upon conviction before any Jus-
