lishing the Relief Fund of the Maryland Racing Commis-
sion and authorizing the Maryland Racing Commission to
disburse funds now held by it in the name of the Board of
Relief—Maryland Racing Commission and certain fines
and penalties hereafter collected from jockeys, trainers,
owners and others and over-payment on the tote machines
to stable attendants and others who become ill or injured
in the performance of their duties on the race tracks in
Maryland and also to pay certain burial allowances.

WHEREAS, in 1921, the Maryland Racing Commission, in
conjunction with the tracks, established an organization
known as the Board of Relief—Maryland Racing Associa-
tions to furnish welfare benefits to indigent jockeys, trainers,
owners and others, and for many years paid over to said
Board of Relief all fines collected from jockeys, trainers,
owners and others and over-payment on the tote machines
for the purpose of furnishing such welfare benefits; and

WHEREAS, the Maryland Racnig Commission in recent years
has questioned the legality of using such funds for furnish-
ing welfare benefits to jockeys, trainers, owners and others and
has accumulated fines in the amount of Five Thousand Eight
Hundred and Forty-five Dollars and Eighty-three Cents
($5,845.83) and over-payment on the tote machines in the
amount of Nine Hundred Thirty-two Dollars and Fifty Cents
($932.50), or a total of Six Thousand Seven Hundred Seven-
ty-eight Dollars and Thirty-three Cents ($6,778.33), and an-
nually collects as fines an additional amount of approxi-
mately One Thousand Dollars ($1,000.00) to Fifteen Hundred
Dollars ($1,500.00); now therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 78B of the Annotated Code of Maryland (1939 Edi-
tion), title "Racing Commission", said new section to be
known as Section 19, to follow immediately after Section 18
of said Article, and to read as follows:

19. The Maryland Racing Commission is hereby author-
ized to establish a special fund to be known as the Relief
Fund of the Maryland Racing Commission. The said fund
will be under the jurisdiction of the Maryland Racing Com-
mission. The said Commission is hereby authorized and
directed to pay into such fund all monies now in the fund
known as Board of Relief—Maryland Racing Commission
and all fines and penalties and over-payment on the tote
machines, except such fines and penalties as may be imposed
