certain injurious insects and diseases, to receive and expend
any sums appropriated to such purpose and to cooperate
with other State and Federal agencies in carrying out the
provisions of this Act.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
48 of the Annotated Code of Maryland (1939 Edition), title
"Inspections", sub-title "State Horticultural Department",
said new section to be known as Section 63A and to follow
immediately after Section 63 of said Article and to read as
follows:
63A. (a) It shall be the duty of the State Board of Agricul-
ture, through the State Entomologist or its duly authorized
officer or agent, to determine whether there exist infestations
or infections which may be controlled in their spread or re-
tarded by airplane dissemination of insecticides, fungicides
and bactericides, and whether there exist animal or human
diseases with a known or suspected anthorpod vector which
may be controlled or their spread retarded by airplane dis-
semination of insecticides, fungicides and bactericides; and
upon such a determination the State Board of Agriculture is
authorized and empowered to employ such means of dissem-
ination, the provisions of Section 9 of Article 1A of the An-
notated Code of Maryland (1939 Edition) or on any other
existing provision of law to the contrary notwithstanding.
(b) In order to accomplish the purposes of this section the
State Board of Agriculture, through the State Entomologist
or its duly authorized officer or agent, is authorized and em-
powered to expend such funds as may from time to time be
appropriated in the State budget or otherwise for use in con-
trolling incipient, emergency or long-standing insect, fungus
or disease outbreaks which in the judgment of the State Board
of Agriculture and its cooperating agencies require drastic
treatment with respect to their immediate elimination as a
menace to the economic welfare and health of the people of
the State.
(c) The State Board of Agriculture, through the State
Entomologist or its duly authorized officer or agent, is further
authorized and empowered to receive from any individual,
corporation, municipality or county funds for the purposes
contemplated in this section and to expend the same for the
purposes authorized herein; to employ personnel and to
execute such work as may be undertaken pursuant to this sec-
tion by contract or free account as it may deem to be in the
best interest of the State.
