SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 7(11) of Article 73B of the Annotated
Code of Maryland (1943 Supplement), title "Pensions", sub-
title "Benefits", sub-heading "Pensions Offset by Compen-
sation Benefits", be and it is hereby repealed.

SEC. 2. And be it further enacted, That this Act shall be
retroactive to June 1, 1941, when Article 73B, creating the
Employees' Retirement System of the State of Maryland,
became effective, in order not to deprive any member of the
Employees' Retirement System of any of the benefits of said
System on account of the payment of any compensation under
Article 101 of the Annotated Code of Maryland on account
of injuries received in the performance of duty.

SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1947.

CHAPTER 118.
(House Bill 17)

AN ACT to repeal and re-enact, with amendments, Sub-section
(6) of Section 99 of Article 77 of the Annotated Code of
Maryland (1943 Supplement), title "Public Education", sub-
title "Teachers' Retirement System", sub-heading "Death
Benefit", eliminating the provision requiring the beneficiary
of a member of the Teachers' Retirement System to have an
insurable interest in the life of said member.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sub-section (6) of Section 99 of Article 77 of the
Annotated Code of Maryland (1943 Supplement), title "Public
Education", sub-title "Teachers' Retirement System", sub-head-
ing "Death Benefit", be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

99.

(6) Upon the receipt of proper proofs of the death of a
member in service there shall be paid to his estate or to such
person as he shall have nominated by written designation duly
executed and filed with the Board of Trustees;

(a) His accumulated contributions and, if the member
has had one or more years of creditable service, in addition
thereto;
