faithfully perform the duties of their office. A majority
of said Judges shall have power to do all things committed
unto said Judges. Any vacancy in said Judges, caused by
death or otherwise, shall be filled by the remaining Judges.
The said Judges shall select a convenient polling place in
the Town of Fruitland for the holding of the special elec-
tion provided for by this Section and shall provide polling
booths, ballot boxes and adequate printed ballots, bearing
the names of all candidates for Commissioner. The polls
shall be open from two P. M. until eight P. M. Promptly
after closing the polls, the said Judges shall count the
ballots and the votes and record the names of the three
persons receiving the highest number and shall publicly
declare the result of the said election. At the first meeting
of the Fruitland Commission elected pursuant to this
paragraph, the said Judges shall present a certified state-
ment of the results of said special election, which statement
shall show the number of ballots cast and the total votes
received by each candidate and be recorded among the
minutes of said Commission.

(B) Any person having the qualifications necessary to
become a qualified voter of the Town of Fruitland, who
desires to become a candidate for the office of Commissioner
shall, at least ten days prior to the date of said special
election, file a petition with the said Judges, which said
petition shall set forth: (1) the name and address of
the candidate; (2) a sworn statement that he or she
possesses the necessary qualifications to become a qualified
voter of the Town of Fruitland; (3) a statement that he
or she desires to become a candidate.

(C) In the event that said special election results in a
tie vote between two or more candidates, which will effect
the result of said election, said Judges of Election shall, as
soon as convenient, hold a run-off election, in which only
the names of those candidates receiving an equal vote
shall be placed upon the ballot, otherwise said run-off
election shall be conducted in accordance with the provi-
sions of this Section.

SECTION 10. And be it further enacted:

(A) That all citizens of the United States, who have
attained the age of twenty-one years, and who are the
owners of real estate, located in the Town of Fruitland,
having an assessed value of at least Two Hundred Dollars
($200.00), (in the event husband and wife own real estate
as tenants by the entireties, assessed at at least Two Hun-
dred Dollars ($200.00), both shall be entitled to register if
