upon conviction thereof, shall be fined Twenty-five Dollars
($25.00), if the uncalled oysters shall have been taken with
tongs, or not less than Fifty Dollars ($50.00), if the
unculled oysters shall have been taken with handscrape or
dredge. In the discretion of the Court, such violator may be
confined in jail for a period not less than thirty days nor more
than six months, or both imprisoned and fined, and in addition
to such fine or imprisonment any oysters in the possession of
said person taken or held in violation of the provisions of said
Section 4, shall be confiscated and returned to the natural
bars or beds under the supervision of the Department of Tide-
water Fisheries at the expense of the violator; and the boat
used in connection with any of the violations of said
Sec. 4 shall be, by the Court trying the case, held as
security for the payment of the costs and fine until same are
paid. In addition to the above penalties the license under
which the violator operated may be suspended or revoked by
said Court.

Any packer, commission man, boatman or other per-
son who shall conspire or agree with any other person
to evade any of the provisions of said Sec. 4 or who shall par-
ticipate in any such violations shall be guilty of a misde-
meanor and subject to the penalties applicable to the violations
occurring under the provisions of said Section.

(c) Tonging. Any person violating any of the provis-
ions of Sec. 5 shall be guilty of a misdemeanor, and upon
conviction thereof, shall be subject to a fine of not less-than
Twenty Dollars ($20.00) nor more than One Hundred Dollars
($100.00) and stand committed to the county jail of the county
in which he is convicted until the. costs and fine are paid.

(d) Dredging in the Chesapeake Bay. Any person vio-
lating any of the provisions of Sec. 6 shall be guilty of a
misdemeanor, and upon conviction thereof, fined not less than
Fifty Dollars ($50.00) nor more than Five Hundred Dollars
($500.00) or be imprisoned in the House of Correction for a
period not less than one month nor more than six months, or
both, in the discretion of the Court; and in addition thereto
any boat, dredge or other device used in connection with the
violation of the provisions of said section may be by the Court
nearing the case involving such violations, declared forfeited
to the State of Maryland and delivered to the Department of
Tidewater Fisheries for such disposition thereof as may, in the
opinion of said Department, be most advantageous to the
State; and in addition thereto the dredging license which has
been issued in connection with the operation of any such boat
may be declared by said Court suspended or revoked.
