truck load, or other consignment of oysters in the shell out of
this State; and an inspection tax of four cents (4c) per
bushel is hereby levied upon all merchantable oysters shipped
in the shell to any place outside the State of Maryland; and
each cargo, truck load or other consignment of such oysters
shall be inspected by the Department of Tidewater Fisheries
and said tax shall be due and payable to said Department
by the person shipping or carrying such oysters out of the
State of Maryland.

16. (a) General Provisions. (1) Whenever the word
"Court" or "Courts" is used in this section it shall mean and
include any Circuit Court of the Tidewater Counties, the
Criminal Court of Baltimore City, any Trial Magistrate of
the said Counties or City, or any Justice of the Peace having
criminal jurisdiction in any of the said Tidewater Counties,
provided such Court, Trial Magistrate or Justice of the Peace
has jurisdiction over the alleged violator.

Any of the above mentioned Courts shall have jurisdiction
to hear and determine any criminal proceeding brought against
any person for the violation of the provisions of this Article
in the event that said violations occurred or were committed
in or on the waters of the Chesapeake Bay, as defined in sub-
section (j), Sec. 1 of this Article, title "Definitions".

If the said violation occurred in or on county waters, as de-
fined in sub-section (i) of said Sec. 1, the Courts having
jurisdiction in the county where the violation occurred shall
have jurisdiction thereof.

When the word "person" is used in this section it shall have
the meaning defined in sub-section (m) of said Sec. 1.

In all criminal proceedings arising from the violation of any
of the provisions of this Article the defendant shall have the
right of appeal in the same manner and to the same extent
that defendants now have in case of convictions for mis-
demeanors.

(2) Any person violating any of the provisions of Sub-
sections 3(d), 3(e) or3(f) shall be guilty of a misdemeanor
and upon conviction thereof shall be fined not less than One
Hundred Dollars ($100) nor more than Five Hundred Dollars
($500), or be imprisoned in the House of Correction not less
than three months nor more than six months, or both fined
and imprisoned, at the discretion of the Court; and any boat
used in any such violation may be seized by the Department
of Tidewater Fisheries and held until any fine assessed by the
Court be paid in full.

(b) Culling. Any person violating the provisions of Sec.
4 of this Article shall be guilty of a. misdemeanor, and
