diate preservation of the public health and safety, and having
been passed by yea and nay vote, supported by three-fifths of
all the members elected to each of the two Houses of the
General Assembly of Maryland, the same shall take effect from
the date of its passage.

CHAPTER 14.
(House Bill 9)
AN ACT to repeal and re-enact, with amendments, Section
153 of Article 66 1/2 of the Annotated Code of Maryland
(1943 Supplement), title "Motor Vehicles", sub-title "Oper-
ation of Vehicles Upon Highways", making the provisions
of said section relating to the operation of vehicles under
the influence of intoxicating liquors or narcotic drugs
applicable to street cars.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 153 of Article 66 1/2 of the Annotated Code
of Maryland (1943 Supplement), title "Motor Vehicles", sub-
title "Operation of Vehicles Upon Highways", be and it is
hereby repealed and re-enacted, with amendments, to read
as follows:
153. (Persons Under the Influence of Intoxicating Liquor
or Narcotic Drugs.) It shall be unlawful for any person who
is an habitual user of narcotic drugs or any person who is
under the influence of intoxicating liquor or narcotic drugs
to drive or attempt to drive any vehicle, street car or track-
less trolley within this State.
Every person who is convicted of a violation of this section
shall be punished by imprisonment for not less than thirty
(30) days nor more than one (1) year, or by fine of not less
than One Hundred Dollars (f$100.00) nor more than One
Thousand Dollars ($1,000.00), or by both fine and imprison-
ment. On a second or subsequent conviction he shall be
punished by imprisonment for not less than six (6) months
nor more than two (2) years and in the discretion of
the court, a fine of not more than One Thousand Dollars
($1,000.00).
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1947.
