270 JOURNAL OF PROCEEDINGS [Feb. 20,

Mr. Cooper, from a Select Committee, reported favorably,

House bill entitled an Act for the improvement of North
Avenue, and to repeal Sections 858, 859 and 860 of Article
4, of the Code of Public Local Laws, entitled "City of Balti-
more," and to re-enact the same with amendments.

Which was read the second time.

The President announced the order of the day to be the
following bill :

House bill entitled an Act to add an additional section to
Article 37, of the Code of Public General Laws, title "Evi-
dence," sub-title "Competency of Witnesses,"

Being upon its third reading,
Mr. Lee submitted the following amendment:
AMENDMENT PROPOSED.

"SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage."

Which was adopted.

Mr. Wilson submitted the following amendment:
AMENDMENT PROPOSED.

Strike out the words, "in any manner whatsoever," and
add, "so far as to make operative any devise to said wit-
ness."

Which was adopted.

Mr. Sulivane submitted the following amendment:
AMENDMENT PROPOSED.

Add at the end of sub-section A, "or in any question of
advancement from parent to child, after the death of the
parent, in a controversy, either in law or equity, between such
child and his or her co-heirs or co-devisees, to permit either
party to be a competent witness to prove any fact tending to
establish either a gift or advancement."

Which was adopted.

On motion by Mr. Miller.

The enacting clause of said bill was stricken out, by yeas
and nays, as follows :
