Said bill was then returned to the House of Delegates.

House bill entitled an Act to amend the Code of Public
General Laws, Article 75, title "Pleadings, Practice and
Process," sub-title "Practice," by adding a new section
thereto,

Being upon its third reading,
Mr. Stump submitted the following amendment:
AMENDMENT PROPOSED.

Add at the end of the section marked sub-section A, "un-
less the Court in which said action was pending shall other-
wise direct."

Which was adopted by yeas and nays as follows :

"If a plaintiff suffers a case to be non-prossed, the defen-
dant shall not be compelled to plead in a second suit for the
same cause of action until the plaintiff has paid the costs of
the iormer case, and upon a failure to pay such costs by the
