Matt: Scarbrough: Dft                             George: Layfield Esqr & Elizabeth his Wife Extrix of the last Will &

~ ~ ~ ~ ~ ~ ~ ~                           Testament of Coll. Wm: Stevens decd of a plea of trespass upon ye Case

And Whereupon the Said George & Elizabeth by Peter Dent their Attorney Complaineth that Whereas the Said

Matthew the 7th day of March 1686 at Monocan within the Jurisdiction of this Court was indebted to the sd Wm

in his lifetime in the Sum of three thousand five hundred Sixty Seven Pounds of tobacco the Ballance of A

Certaine account as by the Said account may appear and also the Sum of one pound Sixteen Shillings & three

pence and one hundred & fifty pounds of tobacco for Sundrys as pr account may appear, and the said Matthew

to the Said William in Manner aforesd being indebted did assume upon him Self, and to the sd Wm faithfully

promise that he the Said Matthew the Said Sums to the sd Wm would well & truly content & pay, Nevertheless

the Said Matthew the Same to the sd Wm in his life time, nor the Said Elizabeth Since the death of the Said

Wm. Extrix as aforesd, nor to the Said George & Elizabeth nor to any of them hath not paid though often requested

but hath hitherto refused, & doth Still refuse to the damage of the Said George & Elizabeth of 8000 pounds of

tobacco, and hereof they bring their Sute. Dent pr Quer.    Plegs     {Jno. Doe

     And the Defendant by Sam: Alexander his Attorney Saith he oweth him Nothing in manner & forme

     and of this putteth him Self upon the Court.             Alexander

                                           And the plaintiffe also. Dent . - -

     September 10:th 1687. Then accompted with Coll Wm: Stevens and all accounts Reconnings and demands

    whatsoever ballanced to the day of the date hereof as Wittness my hand. Will Stevens.

              The Worll. Court having Considered the proceedings herein, doe Conclude the abovesd receit to be signed

              by the hand of Coll. Wm: Stevens. And therefore doe Order a Non Sute agt the plt wth Cost &ca.

     



Coll Browne this day had two Bills proved in Court by one Evidence to be ye act & Deed of David Harris &ca.
