( 42 ) Maryland Ss. Know all men by these presents that I William: Meade of Somerset County am holden & firmly bound unto = David Browne Gent of the Same County in the full & just quantity of two thousand four hundred & fourteen pounds of good sound Merchantable leaf tobacco in Caske to Contain the Same to be paid unto the said David Browne his Heirs Extors Admrs or Assigns Convenient in the County aforesd, to ye which payment well & truly to be made, I bind my Self my Heirs Extors & Admrs firmly by these presents. In Wittness whereof I have here unto sett my hand and Seal this 23d day of April Anno Domini 1692.
The Condition of the above obligation is Such That if the above bound Wm: Mead Bricklayer Shall well & truly pay or cause to be paid unto the abovesd David Brown his Heirs Extors Admrs or Assigns the just quantity of twelve hundred & Seven pounds of good Sound Merchantable leaf tobacco in Caske to Contain the Same Convenient in Monokin or Animessex. Then this present Obligation to be void & of none effect otherwise to Stand remain & be in full force power & vertue Sealed & delivered in William: Mead ❂ Sealed . — the presence of us. – Malkom Camrion his marke James: Rossell. Margarett: Erskin The Defendt. in open Court Confest judgmt. for 1207 pounds of tobacco & this Court grants Order for the same with Cost alias Executio.
James: Weatherley Plt. Somerset County Ss// Contra John: Wheeler late of this County Planter was attached to John: Wheeler. Defendt answer unto James: Weatherlie of a plea yt he render unto him and Caske which to him he oweth & unjustly detaineth ---- And whereupon the Said James by Peter Dent his Attorney Saith that the said John: the 15th- day of April in the year of our Lord 1691: at Monokin within the Jurisdiction of this Court was indebted to the Said James as by his Certain bond or writing Obligatory, which the Said James, with the Seal of the said John Signed bringeth here into Court the date whereof is the day & year aforesd acknowledged him Self to be bound to the Said James in the Said full & just Sum of 10000 pounds of good Sound Mertable tobacco to be paid to the Said James, to the which payment well & truly to be made & done the said John. bound him Self ffirmly by the Said Bond. Nevertheless the Said John the Same to the said James hath not paid to the damage of the Said James of 12000 Pounds of tobacco & thereof he brings his Sute &ca. Dent pr Quer Pleg &ca. Jno Doe Rich: Roe And the said John: Comes & defends the force & injury & prayes the hearing the said Bond & it is read to him he prayes also the hearing the Condition of the Said Writeing & it is read to him in these words. The Condicon of the above obligation is Such that if the above bounden John: Wheeler Shall on his part well truly & faithfully & honestly serve the above named James Weatherlie his Heirs Extors Admrs or Assigns the full time or term of two years from the date above Written in Such Service & imploymt. as the sd James Wetherlie his heir &ca shall Sett him to or imploy him at dureing the Said term & shall in all things behave himSelf abide Stay & bear in all things dureing the said term in
