Defendt. to answer unto George Layfield Esqr. & Eliz. his Wife of a plea that he render unto them the full & just Sum or quantity of four thousand five hundred & fifty & three pounds of good Good Sound Merchantable tobacco & Caske which to them he Oweth & unjustly deteineth &ca. - - - - ____ - - - And whereupon the Said George & Eliz. by Peter Dent their Attorney Say that whereas the Said Thomas the 28th day of ffebruary in the year of or Lord 1688/9 at Pocomoke within the Jurisdiction of this Court was indebted to the said Elizabeth by the name of Elizabeth Stevens as by his Certain Bill Obligatory under the hand & Seal of the Said Thomas Kinsey for the Said full & just Sum of 4553: the date of which Bill is the day & year aforesd to be paid to the sd Elizabeth to the which payment well & truly to be made & done, the said Thomas bound himself firmly by the Said Bill Nevertheless the Said Thomas the Said 4553: Pounds of tobacco to the Said George or Elizabeth or to either of them, the Same hath not paid, but hath hitherto refused & doth Still refuse, to ye damage of the said George and Elizabeth of 8000 Pounds of tobacco, & thereof they bring their Sute Dent pr Quer.
