The plea should have been inserted under ye Decln in fo: 21 Worthington Ja. Sangster & Law.Gary Evid of ye Dft. & the plt also Dent George: Layfield &ca Plt: Somerset County Ss. Contra Wm. Lawrence late of Somerset Couny was Sumoned to answer unto George Wm: Lawrence. Dfendt. Layfield & Eliz. his wife Extrix of Last Will & Testamt of Coll Wm. Stevens ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ decd of a plea yt he render unto them the just Sum & quantity of four thousand pounds of good fatt beef with the Tallow belonging which he oweth & unjustly deteinth And whereupon the said George & Eliz.by Peter Dent their Attorney Saith that whereas ye Said Wm.Lawrence y Seventeenth day of July in the year of or Lord 1681 at Pocomoke within ye Jurisdiction of this Court by his Certain Writing Obligatory acknowledged himself to be bound to ye Said Coll Wm Stevens in his lifetime in the aforesd Sum of One thousand pounds of Beef with the Tallow to be paid to the said Coll Wm:Stevens, when he shall be thereunto required, Convenient at Snow= Hill Landing, Nevertheless ye Sd Wm. although often required ye said 1000 pounds of Beef wth the tallow to ye Sd Wm Stevens = in his life time nor to the said Eliz. Since ye death of the said Wm: Stevens while she was Sole & unmarried nor to the said George & Eliz since ye marriage between them had & Consumated nor to any of them hath not rendered, but hath hitherto refused [of] and doth still refuse to ye damage of the Said George & Eliz: of 2000 Pounds of Beef, and thereof they bring their Sute &c and they bring here into Court the letters Testamentary of ye Said Wm: Stevens, whereby it may appear the Sd Eliz. to be Extrx and to have Admrn. Dent pr Quer Pleg. &ca. Jno. Doe Rich Roe ]
And the Sd Wm:Lawrence Comes & Defends the force &ca. & prayes the hearing the Writing aforesd & it is read, he prayes also the hearing the Condicon of the sd Writing and it is read unto him in these words The Condicon of this Obligation is Such that if the above bounden Wm: Lawrence his Heirs Exters of Admrs shall & doe well & truly pay or Cause to be paid unto ye above Named Wm: Stevens his Certain Attorney Extors Admrs or Assigns the full Sum of five hundred Seventy & one pounds of fatt beef at or upon ye first day of October next ensueing the date hereof at Some Convenient place in Snow hill Landing with out fraud or further delay then this Obligation to be void & of none effect else to be in full force & vertue.
And the Defendt by his Attorney Sam: Worthington Comes & acknowledgeth the Bill & pleads Satisfaction - - and puts him Self upon the Court. Worthington & ye plt also. Dent. }
