March the 18th 1686/7. Then received of George Latcham two hhds of tobacco neat eight hundred & two pound for ye use of Coll. Wm. Stevens I say recd by me. Jno. Smocke. The prmises Considered pr this Court doe Order a Non Sute agt ye plt wth Cost alias Executio.
George. Layfield &ca. Plt. Somerset County Ss. // Contra: } George Latcham late of Somerset County Planter was attached to George: Latcham. Defendt answer unto George: Layfield Esqr. & Eliz. his Wife Extrix of Coll - - - - - - - - - Wm: Stevens deceased, of a plea of trespass on the Case &ca.
And whereupon ye said George & Elizabeth by Peter Dent their Attorney Complains that whereas the sd George Latcham the 26th day of March in the year of our Lord 1687. was indebted to ye sd Coll Wm Stevens in his life time in the Sum of five hundred pounds of tobacco being for Sundry goods & Merchandizes by the Said Wm. in his lifetime to ye sd George Latcham Sold & delivered as pr a perticular accot thereof hereunto anexed, And the Said George:Latcham to the Said Wm:Stevens in manner aforesd being indebted, did assume upon himself and to ye sd Wm. in his life time faithfully promise that he the the sd Sum of tobacco Would well & truly Content & pay. Nevertheless the said George Latcham the said Sum of 500:Pounds of tobacco to the sd Wm. Stevens in his life time now to the sd Eliz. Since the death of the said Wm: now to the sd George:Layfield Elizabeth Since the marriage between them had & Solemnized, nor to any of them hath not paid to the Said George Layfield & Eliz. of 1600: Pounds of tobacco and thereof they bring their Sute and they bring [to] Court the letters Testamentary whereby it appears the said Eliz to be Extrix & thereof to have Admrn.
