assume to pay unto the plt when thereunto required But the deft not regarding his promise & assumption but

fraudulently intending y^e plt to deceive, in the Sum of 200 pounds of tobacco though often thereunto required but

hath refused to pay & Still doth refuse Whereupon the plt Saith he is damnified & hath losse to the value of 400=
