( 12 ) The Condicon of the aforesd Recognizance is Such that if the above bound James. Weatherley doe pay his fines awarded as also be of the good behaviour and abearance to all their Maties Liege people of this Province dureing ye Courts pleasure and likewise doe pay the fees acrued thereon then the Recognizance to be void & of none effect otherwayes to be and remaine in full power force & vertue.
To the Worll Justices of their Maties Peace for ye County of Somerset in Court now Sitting - - The Petion of Jno Cropper humbly Sheweth - - - That whereas yr Petioner had a plantation left unto him by his ffathers last Will your Petionr last Court was in Open Court proven to be Jno Cropper his Heir. Coll. David Browne. Plt. Somerset County Ss // Contra } Robert: Catling of this County of Somerset & Province of Maryland Planter was Sumoned to answer unto David Browne of the Robert: Catling. Defendant. Same County in a plea of debt &ca. - - - - - - - - - - ~ ~ ~ ~ ~ ~ Whereupon the Said David by his Attorney John: Strawbridge Comes and Saith that the Said Robert became indebted unto the Said Browne in the full & just Sume of one hundred fourty eight & One half pounds of good Sound Merchantable Neat Porke as doth appear by a Certain Instrument under the hand & Seal of the Said Robert bearing date the fifth of October 1691. and upon the non payment of the Said Porke as in Said Instrument is expressed, did bind him Self his Heirs Execcutors & Admrs firmly in the Sume of five hundred pounds of Merchantable tobacco in Manokin River by the last of November ensueing the date of the Instrument at the house of the said Browne But the Said Robert no way regarding his promise but fraudulently intending the sd Brown in that behalf to deceive hath not paid the Sume aforesd, whereupon the plt Saith he is damnified & hath losse to the value of two hundred ninety and Seaven pounds of Porke & hereupon brings his Sute Jno Doe Strawbridge pr Quer // Pleges do prosecs Rich Roe }
~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Maryland Ss // Know all men by these presents that I Robert Catling Planter of Somerset County am holden & firmly bound unto David Browne in the full & just qt. of five hundred pounds of good Sound Merchantable leaf tobacco in Caske to Contain ye Same to be paid unto the Said David Browne or his Heir Exters Admrs or Assigns Convenient in Manokin River by ye last of November next to the Said Browns house to the which payment well & truely to be made I bind my Self. Heirs, Exters & Admrs firmly by these presents. In Wittness whereof I have hereunto Sett my hand & Seal this 5th day of October ano Domini 1691 ==
The Condition of this Obligation is Such that if ye above bound Robt.Catling Shall well and truly pay or Cause to be paid unto the abovesd David Browne at his house or to his Heirs Extors or Admrs or Assigns the just quantity of one hundred fourty & eight ½ pounds of good Sound Merchantable Neat Porke before the time abovesd. That then this present Obligation to be void & of none effect otherwise to Stand and remaine in full force & vertue.
