( 100 ) The aforesaid Petion being read & Considered. It was then by the Justices Ordered that the sd two Sonns (viz) George Smith & James Smith doe live & abide with their sd Mother Maren: Smith until they attain to eighteen years of
age.
Upon petion of Thomas Williams for Remittmt from Bonds of Behaviour It was by the Court Considered & Ordered That the Said Thomas be released therefrom & proclamation thereof made which was pr Cryer Executed & the sd Williams Cleared

Their Maties Somerset County Ss // Contra } The Grand Jury for ye body of Somerset County at a Court held for the Said County on ye Second Mary: Swaine Tuesday in March last, upon their Oathes, do present Mary: Swaine of this County for that ~ ~ ~ ~ ~ the Said Mary Some time on or about ye 30th.day of July in the year of or Lord 1693 within The Jurisdiction of this Court, not having the fear of God before her eyes, but moved by ye instigation of ye Divil,& of her own wicked mind, the Said Mary the Sabbath day Comonly Called the Lords day the Same in a most wicked & Sinfull manner did prophane & abuse by Swearing & other bodily labour to the Evil Example of others agt the Peace of or Sovereign Lord & Lady the King & Queen, and agt ye Act of Assembly of this Province in this Case provided // Dent Clk prsentmts The Indictmt. being read to which the sd Mary pleaded not guilty & for tryall referrd to a Jury and therefore Comand was given to Sumon twelve good & lawfull men of his Balywick, that the matter then in hand might be the better understood a List or panel whereof returned as followeth (viz) Tho: Dixon. Jno.Roach Junr Nic. Evins Henry Hudson Senr Robt Catlin Graves:Jarrett. John: Heath Samll: Marchment. Rich: Wharton. James: Hill. Tho:Wilson Capt.Wm:Piper.12) who having heard the foresd Indictmt. and, the Evidences Sworn & examined receives their Charge & are Sent forth — And this day (viz) ye day abovesd. The Jurors of sd Jury returns to the Barr in Court, the plts & Deft being Calld as also the Jurors, who being unanimously agreed of their verdict (which is read as followeth viz) Wee of the Jury find Mary: Swain not guilty of the Indictmt Tho: Dixon Which verdict was Ordered to be entered. And the sd Mary was then pr Proclamacon } Cleared & ordered to pay Cost of Sute.
