( 55 ) 16th. 7 ber . 1692 Trespassed & grieviously Endamaged the whole County by Erecting of a Water mill under pretence of a public benefitt, & thereby without Law, Order of Consent of grand Enquest hath altered, Damed up & Spoiled their Maties high way lying on Monokin River & Stopped up Two Navigable Creeks with his Dam: That Severall of their Maties Subjects are thereby ruined (with) their lively hoods, besides the extream damger hath allready happened to the Inhabitants having Occasion to ride that way, & is likely to happen, if yr worpps doe not Speedily prevent the Same Since it is a publick annoyance & erected for a private Interest to procure a public damage. There fore yr worps Petioners humbly Craves that yr worps would inspect into the miserable Condicon we Shall be in , when the Laws are not regarded, nor Order of the Court Obtained, but that ye sd Smith or his Attorney Should doe what Seems good in his or their own eyes, having no regard to ye public- and yr Petioners Shall in duty pray . __________ - - - - - - Tho: Wilson. Andrew: Whittington After wch Petion was read the Court demanded Richard Chambers. of mr Henry Lynch how he would be tryed. the Saml: Tomlinson Said Lynch answered the Court he would appeal to the Provincial { Roger. Burkum Court which appeal was by the Court granted. And Ordered Wm: Wilson Henry: Philips. That the Said Lynch give good Security to prosecute sd appeal with effect. Where upon Came ye Said mr. Henry: Lynch with his Securities viz Stephen Luffe & Teague Riggen Junr. & the sd Lynch did acknowledge & confess himself to be indebted to their Maties in the Sum of fifty pounds Sterling & the said Luffe & Riggen did acknowledge themselves indebted likewise in the Sum of twenty five pounds Sterling money all due to be leavied on their goods & Chattels land & Tennemts. for their Maties uses &ca. _____ - - - - - _____ - - - - - - - - _______ The condition of which Recognizance is Such that if the sd Henry Lynch above bounden doe at the next Provincial Court prosecute an appeal granted him this day wth effect, agt the Inhabitants above mentioned then the Recognizance to be void & of none effect Otherwayes to be & remaine in full power force & vertue . ______ which sd appeal to sd Lynch & Securities upon Complaint to Court was dismist ________ - - - - - - __________________ ~ ~ ~ ~ ~ ~ Wm: Beddard.
