( 52 ) 7ber 15thB 1692 . according to the tenour of the Said Sumons, whereby the said Cheesman hath evaded his tryal & their Maties frustrated of a material Evidence Therefore Craves judgmt may be entered agt the dft according to Law in that Case made & provided Ja. Sa. Clr. IndtsC The Indictmt being read. The Said Conner was dismist as not shewing Cause &ca. but not dismist as Evidence ye action still remaining upon the Dockett agt Cheesman Their Maties Somerset Sc. Sarah Taylor was Sumoned to answer what Contra } Shall be Objected agt her in their Maties behalf . And whereas C Sarah: Taylor their Maties. Comes & Sayes. That whereas Wm. Cheesman of ~ ~ ~ ~ ~ this County Planter, was prsented in 9ber Court last past by the Grand Jury for the body of this County for breach of the Act agt hoggstealers, and the said Sarah being Legally Sumoned to appear as Evidence for their Maties agt ye Said Cheesman She the said dft did not appear at ye County Court according to the tenour of the Said Sumons, but Contemptuously refused the Said Sumons to obey, whereby the Said Cheesman, did Evade his tryal & their Maties dissappointed of a material Evidence. Therefore Craves judgmt may be entered agt ye dft According to Law &ca Ja: Sa. Clr Indtmts The Indictmt. being the Said Sarah was dismist, as not Shewing Cause &ca. C Somerset Sc // Whereas a Comission hath been issued forth to us to Appraise ye Goods belonging to the Estate of mr Wm: Hearne. Deceased.
