Robert Smith  Labourer and by him Charged with many disorders & grosse misdemeanrs
agt his Said Master & Dame (vizt) that he laid violent hands of both his Master & Dame
& had like to have murthered them:  The marks notoriously appearing upon his Masters besides
the threatning them & laying wait for them with a great knife &ca. as also threatning his
Masters house Shall not Stand long.  These are therefore to will & require ye to receive the
Said Owen Oroiake into yr Safe Custody. So that yw may have his body before or Justices
the next Court to be holden for this County, there to answere to what Shall be then & there C
Objected agt him by his Said Master & Dame. & hereof yw are not to fail. Given under our hands
& Seals this day & year abovesd . -   -   -   -   -   -   -   ffr: Jenckins           „  Sealed
  To mr Edward Harper Constable of Pocomoke          George: Layfield  „  Sealed
  hundred who is hereby required to take y abovesd from the hands of Hough. Porter &
him Safely to Convey to the Sheriffe as aforesd, which in their Maties Names he is Stricly to observe

   The Deposition of Robert Smith Junior aged twelve years C
Whereas upon the 31: day of August my ffather Robert: Smith having reproved his man Servt.
for an Offence done, gave my ffather Saucy language, my ffather told him his tongue was too
long, he desired my ffather to come & chipp it, if he could, or take yw Saith his Servant One
Club & I will take another, & we will Club it out. & afterward when my father & Mother was
in bed, he gott one great knife, & Said now I have got a Clubb, & challenged my ffather to B
rise & come out & he would end it, & in morning next, before my ffather rose, Owen my
ffathers Servant calld my ffather to rise, for he was ready to go before a Comissioner, & when
my ffather was risen he took up a Stool & Struck at my ffather, & Said that he would beat out
his brains, and also catched hold of an candlestick made of peuter, & Struck at his face & cut
him, & Said he would never Serve him one hour, neither  Said he shall goe (speaking to my
ffather) enjoy your brave building, but I shall be allwayes laying upon yw this ye Deponent
Saith & no farther.
 The sd Robert Smith being Examined his wife & Sonne, likewise ye sd Owen who Confessed to part
of what alleadged  ______    - - - - - -    ________   - - - - - - - - -    ____________    - - - - - - - -
Which by this Court being Considered, & Ordered that sd Owen be taken into Sher: Custody & him
to Carry to the whipping post, and there to give him the sd Owen thirty lashes upon his bare back
well laid on which by the Sheriffe was executed :  Ordered  likewise the sd Owen pay unto
his Said Master three months Service for his damages. C   After which the sd Robert Smith
Assigned all his right interest & title  of the said Servant Owen Oroiake to mr Stephen Luffe
