244. Upon request of Capt. Henry: Smith. It is Ordered by this Court, That Agnes = Browne wife of John:Browne & Hannah:Hales Servant to mr Tho: Wilson be Sumd forthwith to appa. before the Justices in Court Sitting to answer complaint of sd Smith. Sums Ordered in Court for Saml. Marchment Evid for mr Tho: Jones agt Ja:Maynard Their Maties Somerset County Ss // Contra } The Grand Jury for the body of this County on the 15th day Tho: Williams . of March in the year of or Lord 1692/3 at Monocan within ~ ~ ~ ~ ~ ~ ~ ~ the Jurisdiction of this Court upon their Oaths doe prsent Thomas:Williams of this County, for that the Said Thomas not having the fear of God before his eyes, but moved by the instigation of the divall, Sometime in the month of October in the year of our Lord, did carnally lye with, or offer to lye with Eliz:Spear Daughter of Andrew:Spear, to the great dishonour of God, the Evil example of others and agt the Peace, the Clk of Presentmts prayes judgmt agt the Sd Thomas:Williams Dent Clk prsentmts Indictmt being read, to which the sd Williams pleaded not guilty C Whereupon Comand was given to the Sheriff to bring here twelve good & lawfull men of his Balywick that the matter in hand might be the better understood, a List or pannel whereof are returned as followeth (viz) Matthew:Scarbrough. Richard:Ackworth, Robt Burridge. Abraham: Emmett. Tho: Humphreys. Jno:Perkins. Rowland: Beavins Robt Smith. Tho: Oxford. William: Richardson. John:Gray. Hen: Hall. 12. who being legally Sumoned returned & Sworn upon the holy Evangelists, having heard the Evidence for their Maties. (viz) Andrew: Chappell. Sworn & examined as also ye Evidence for defence Examined, receives their Charge & are Sent forth in Order to determine ye matter. _______ And this day (viz) the day & year aforesd Came the foresd Jurors of that Jury betwixt their Said Maties and Tho: Williams to the Barr in Court, and being all Perticularly calld by their Names, are all unanimously agreed of their verdict, their; Maties & the Dft being likewise Calld. The verdict is read in these expresse words - following (viz) The Jurors cannot find the Indictmt. Given by Matt:Scarbrough foreman This Court Orders the foresd verdict to be entered. Order Jurors ffees. Ordered the sd Tho: Williams give Security for his good behaviour & fees. C Whereupon Came the foresaid Tho: Williams with his two Securities (viz) Robt. Catlin & Jno:Perkins. And the sd Williams did acknowledge & Confesse himself to be indebted to their Maties in the Sum of One hundred pounds Sterling money of England, & the Sd. Catlin & Perkins in the Sum of fifty pounds a piece like money afd, all due to be leavied upon their goods & Chattels |
