Somerset County Ss // Contra } Moses ffenton late of this County was attached to answer Moses Fenton Dft unto John: Ellis of a plea of trespass on the Case ~ ~ ~ ~ ~ ~ And whereupon the Said John: by Peter Dent his Attorney Complains that whereas the Said Moses the 10th:day of March in the year of our Lord 1691/2 at Pocomoke within the Jurisdiction of this Court was indebted to the Said Moses in the Sum of tenn bushels of Indian Corn, being for So much by ye sd Moses (to the) Said John assumed to be paid for accot of Robert:Peale and the said Moses to the Said John (in) manner aforesd being indebted did assume upon himself & to the Said John:faithfully promise that he the Said Moses the Said tenn Bushells of Corn to the said John:when requested would well and truly content & pay, Nevertheless the Said Moses his promise & assumption aforesd not regarding but minding & fraudulently intending the Said John in this behalf to deceive & defraud the Said tenn bushells of Corne to the Said John hath not paid to the damage of the Said John. of 1600 Pounds of tobacco & thereupon he brings his Sute &ca. Dent pr Quer Plegs &ca { Jno. Doe Rich:Roe} Non assumpsit in manner & form pr defendt. to be enquired by the Court Ja: Sangster The aforesd Decl being read & Considered a Non Sute was pr Court granted agt the plt. wth Cost als Executio Nicholas: Lisney Plt Somerset County Ss // Contra } Richard Maclure late of this County was attached to answer Richd. Maclure. Dft. unto Nicholas Lisney Of a plea of trespass on ye Case &ca ~ ~ ~ ~ ~ ~ ~ ~ And whereupon the Said Nicholas by Peter Dent his Attorney Saith the sd Richard the 1st . day of ffebruary in the year of our Lord 1691/2 at Pocomoke within the Jurisdiction of This Court was indebted to the Said Nicholas in the Sum of four hundred pounds of tobacco as by a Certaine Note Subscribed with the propper hand of him the Said Richard as by the said Note here in Court produced may appear, and the Said Richard to the Said Nicholas being indebted did assume upon himself & to the Said Nicholas faithfully promise that he the Said Richard the said Sum of 400 Pounds of tobacco to the Sd Nicholas would well & truly Content & pay Nevertheless the sd Richard his promise & assumption aforesd not regarding but minding & fraudulently intending him the Said Nicholas in this behalf to deceive & defraud the Same to the said Nicholas hath not paid, but hath hitherto Refused & doth Still refuse to the damage of the said Nicholas of One C |
