( 194 ) March 16th 1692/3 (Charles) Mullen. having attended as an Evidence in behalfe of their Maties agt Wm. Burch four dayes Craves yr worps Order for Attendance. March 16th. 1692/3 Sworn before me John: King ___________ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ To the Worll. Justices of their Maties of the Peace in Court now Sitting The humble Petion of John:Swaine humbly Sheweth C That whereas yr Petioner hath met wth One accident, that hath befallen me, which was a piece of timber falling upon my (leg) whereby I am lame requesting yr worps that yw would be pleased to grant a reference (till) next Court, & then God willing I shall appear, and yr Petioner as in duty bound Shall (ever) pray C John. JS Swaine his marke C wch petion by ye worll Crt was granted Their Maties The said Ellis Coleman being Calld, & appeared in Court Contra } but for want of Evidence his tryal was Continued till June Crt Ellis Coleman Ordered by the worll. Court that Ellis Coleman give Security for himself et uxer. & his Wife Damarias appearance at or next County Court to be holden ~ ~ ~ ~ ~ the Second tuesday in June to answer to their Maties &ca ____ - - - - Whereupon Came the Said Ellis with his Securities, viz) Anthony Jones & Wm: Bowden & the sd Coleman did pr Recognizance in Open Court Confess himSelf to owe & be justly indebted to our Soveraign Lord & Lady Wm & Mary King & Queen of England &ca the Sum of fourty pounds Sterling money of England, & the said Jones & Bowden in the Sum of twenty pounds Sterling money asd, due to be leavied on their goods & Chattels lands & Tenemts for their Maties uses &ca. ________ The Condition of this Recognizance is Such that if the above bound Ellis Coleman & his Wife Damarias doe make their prsonall Appearance at our next County Court to be holden the Second tuesday in June then & there to (answer) to such thing as Shall be Objected agt them On behalf of their Maties then the Recognizance to be void & of none effect, Otherwayes to be & remaine in full power force & vertue Walter: Lane Plt. Somerset (County ) Contra } Somerset Dickinson of this County (was) attached to answer Somerset:Dickinson unto Walter Lane, Extr & Admr of the goods & Chattels of ~ ~ ~ ~ ~ ~ ~ Josias Seaward late of this County deceased in a plea of trespass On the Case & whereupon the plt by James Langster his Attorney Comes & Sayes that the Said Dft is become & Stands indebted to the Estate of the said Josias Seaward deceased the |
