( 193 ) March 16th 1692/3 Jurisdiction of this Court then & there being Severall hoggs of the propper hoggs of Benjamine Cottman of this County of the value of three hundred pounds of Porke the (same) did wickedly & felloniously, thieve Steal & Carry away Contrary to the Peace & against the form of an act of Assembly in that Case made & provided Dent. - - (The) Indictment being Read to which the sd Wm. Layton pleaded not guilty. Whereupon Cmd was given to the Sheriff of this County to bring here twelve good & lawfull men of his Balywick that the matter in hand might be the better understood, a List or pannel whereof are returned as followeth (viz) James:Curtiss. Alexandr. Thomas. Law. Gary. Jame Langreen. George:Goddard. Moses:ffenton. Richard:Cary. Somerset:Dickinson. Jno. Gray Roger: Odowey. Tho:Smith. Wm:Wallis. 12. who being legally Sumoned returned & Sworn upon the holy Evangelists; who having heard the foresd Indictmt. as also the Evid Sworn & Examined. receives their Charge & are Sent forth _____________ Evidences Sumd for their Maties were Bernjamine Cottman. Tho: Rolph & Tho:Horseman Only Tho:Rolph. was Sworn. - - - - - - _____ - - - - - - - _______ - - - - - - - - - And this day to witt the 16th: day of March as aforesd Came the Jurors on B tryall betwixt their Maties & the sd Layton; being each man perticularly calld By his Name, & being all agreed of their verdict, the plts & dft likewise Calld the verdict is in these express words read. (viz) Wee of the Jury doe find William Layton guilty of the indictment, that is to Say for one hogg weighing eighty four pounds. James: Curtis: foreman. _______ - - - - - - __________ Which foresd verdict this Court Orders to be entered. Ordered likewise pr Court that Wm Layton pay the fourfold viz three hundred thirty Six pounds of Porke to Benjamine Cottman. Ordered into Sheriffs Custody till Security given for the sd fourfold & fees. Ordr Jurors fees. // Whereupon Came the Said Wm:Layton with his Security Cornelius Anderson. and the sd Layton did acknowledge himself to be justly indebted unto their Maties in the Sum of tenn pounds Sterling money of England & the sd Cornelius in the Sum of five pounds like money due to be leavied on their goods & Chattels Lands & Tenemts for their Maties uses &ca. __________ The Condicon of which Recognizance is Such that if the above bound Wm:Layton (in) the judgmt of this Court with Cost of Sute, then the Recogniz. to be void otherwayes to remaine in full force & vertue . _____ |
