( 189 ) March 15th 1692/3 // Their Maties Somerset County Ss // Contra } The Grand Jury for the body of this County upon their Oaths Mary Macmillion doe prsent Mary. Mcmillion late of this County Spinster, for yt ~ ~ ~ ~ the Said Mary not having the fear of God before her eyes but (moved) by the instigation of the Divel, on the 27th. day of September in the year of our Lord 1692 at Monocan within the Jurisdiction of this Court, then & there being four yards of Virginia - olen) Clothe of the value of two hundred pounds of tobacco of the Cloath of Wm:Nox the Same did wickedly & felloniously thieve Steal & Carry away Contrary to the Peace & against the form of an act of Assembly in that Case made & provided. pr Bill found Billa vera pr Gr:Jury R. Chambers // Dent Clk of presentmts Indictment being read to which the Said Mary pleaded not guilty & for her tryall was referrd to the Country. Whereof Comand was this day given to the Sheriffe to bring here twelve good & Lawfull men of his Balywick that the matter in hand might be the better understood a List or pannel are returned as followeth. viz. Wm: Bozman. John:Kellam. John Jones. Mony John: Starlin George: Lane. Miles: Gray. Saml. Johnson. Anthony: Jones. Teague: Quillaine ffrancis: Roberts Teague Riggon. Junr & Thomas:Gillett 12.) who being legally Sumoned & Sworn upon the holy Evangelists having heard the foresd Indictmt read as Seen & heard these seaven Evidences for their Maties Sworn & fairly Examined, receives their Charge & are Sent forth. ____ Evidences Sworn & Sent up to the grand Jury, as also to ye Petty Jury were Rhodiah. ffranklin. Jno. Coleston. Anne. Coleston. Agnis Davis. Wm: Knox. Edwd. Davis Jaine:Wife to James Barry. __________- - - - - - - - - - - _______ - - - - - - - - - - - - And this day to witt the 15th: day as aforesd Came the Jurors of the foresd Jury on tryall betwixt their Maties & the sd Mary Mcmillion, being perticuliarly Calld each man by his name, & being unamously agreed of their Verdict, the plts & Defendts being likewise calld. the verdict is read in these words following (viz) Wee of the Jury doe find Mary Mcmillion guilty of thee Indictment. Wm: Bozman foreman Which Verdict the Court Ordered to be entered, and further Orders the said Mary pay the fourfold to & viz 380lb tobacco The Said Mary Submitting her Self to Court. Corporall punishment was remitted paying fees & (Costs?) Ordered Mary give Security for ye sd 4 fold & fees. Whereupon Came the Said Mary & her two Securities viz. Jno:Coston & Thomas Roberts & the Said Mary did Confess pr Recogni(zance to be justly) indebted to their Maties the Sum of tenn pounds Sterling money of England & the sd Coston & Roberts in the Sum of five pounds like money (due) to be leavied on yr goods & Chattels Lands & Tennements |
