( 188 ) March 15th. 1692/3 To the worll. their Maties Justices of the Peace for the County of Somerset in Court (Sitting) The humble petion of Arnold Elzey humbly Sheweth, That Whereas Sarah Whitty the Daughter & Orphant of Capt. Rich:Whitty late of this County deceased was left joynt Extrix with Dorothea:Whitty by the last Will & Testament of the sd Whitty and the Said Dorothea hath turned away the Said Orphant who is now at ye Petioners house. Your Petioner Craves that yr worpps would Consider the Condicon of the Said Orphant and her Estate into yr worpps Custody, or take or appoint her a guardian who as the Law directs may be accomptable for the Said Estate. Your Petioner being Willing to keep her, if yr worps think it fitt, or appoint her any other whome yr worps may Confide in for her upbringing which is the humble Petion of your worpps Petionr who Shall as in duty be ever bound to pray // March 15th: 1692/3 // The Petion being read it was then by the worll Court Ordered that Sarah:Whitty Orphant be kept in Custody of Arnold Elzey till June Court next. Ordered also That Arnold Elzey bring to Court the said Sarah while the Court Continues. and upon The 16th day of March ano. 1692/3. at request of mr Samuel: Hopkins Dept Comissary It was Ordered that Dorothea:Whitty Relict of Rich Whitty doe appear the day following before the Justices in Court Sitting. ____ And upon the 17th. day of March ano. 1692/3 The sd Dorothea & Sarah both appeared in Court, The said Rich:Whitty=s Will was then Read. The Court demanded of sd Sarah where her desire was to live, whose reply was at her Brother Arnold Elzeys, whereupon it was again Ordered that She continued at the sd Arnold Elzeys till June Court B Likewise by mutuall Consent of Dorothea Whitty Relict of Capt Richard Whitty decd and in Court Sitting that mr. John Bozman & mr George Betts doe take a particular accot of the Estate of Capt.Rich Whitty deceased . ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Sundry Depositions Sworn to agt Ellis Coleman ~ ~ ~ ~ ~ ~ ~ ~ To the worll. their Maties Justices of the Peace for ye County of Somerset in Court Sitting ye humble petion of Tho: Roberts sheweth that yr Petioner was bound to the behaviour June Court was twelve month & have behaved my Self Orderly to all their Maties Liege people ( ) & humbly Craves yr worps would be pleased to release yr Petioner of his bonds & yr Petioner as in duty bound Proclamacon was made & the Said Bond remitted. |
