of March in the year of our Lord 1690  Then did promise & assume upon himself
to pay unto the Said Jones the Sum of  One thousand six hundred Seaventy One
pounds of tobacco being for the like sum of tobacco due to the Said Jones from William
Morris, which Said Sum of 1671. pounds of tobacco the Said Thomas Quillaine did
promise & assume to pay to the Said Thomas Jones, as doth appear by a Certain writing
under the hand of the Said Thomas Quillaine & here in Court produced and the Said
Quillaine to the Said Jones in manner aforesd being indebted did assume upon him
Self to pay to the Said Jones the aforesd Sum 1671: pounds of tobacco when he Should
be thereunto requested, would well & truly Content & pay Nevertheless the said Quillaine
his promise & Assumption litle regarding but fraudulently intending the plt to deceive
in Sum of 1671:pounds of tobacco although Often demanded but hath hitherto refused
and doth Still refuse, whereupon the plt Saith he is damnified & hath loss to the value of
3000 pounds of tobacco & thereupon brings his Suite.

     The Dft. defends the force & Injury &ca. and Sayes that the dft by the sd writing
produced in Court is not bound to the plt for the Said Sum alleadged, by reason that the
plt hath discharged the Said Assumption, by taking Bill of the said Morris Since the date
Of the Note, & this he desires may be inquired of by the Country.  Ja: Sangster C
 
And the Dft Said Plaintiffe Sayes he has not discharged the sd assumption

Then was produced the two following papers (viz)
 M^r. Thomas Jones. after my Service to y^w, these are to satisfie y^w that I will be my ffathers
Morris Security for what he Owes y^w, and if y^w please to take tobacco, I will pay you
eight hundred in Henry Hudsons hand, & four hundred in John:Taylors hand ready
down all at p^rcent from y^r friend & Servant      Thomas Quillaine

Thomas: Quillaine pay unto Thomas: Jones or his Order the Sum of Sixteen hundred
Seaventy & One pounds of good clean tobacco which is the Sum y^t are my Security for & is to be
present pay as by y^r note appears. make good payment & place to y^e acco^t of
