Their Maties Attorney Sayes that the said Porter ought to Suffer the pains & punishments according to Law inflicted upon such Offenders and therefore Craves judgmt. may be entered accordingly. _____ James:Sangster Clr Indtmts. _______ The Indictmt being Read to which the Said Porter pleaded not guilty and for his tryal put himself upon the Country _____ Whereupon Comand was given to the Sheriffe to bring here twelve good & Lawfull men of his Balywick that the matter in hand might be the better known, A list or pannel whereof are returned as followeth viz Wm:Piper: Daniel:Hast. Wm:Harris: Matthew:Wallis Saml:Jones Teague Quillaine. John:Jenner. Henry Philips. Gydeon: Tillman. Tho:Willis= David Griffis. Nicholas Evins. 12) who being legally returned impannelled & Sworne upon the holy Evangelist, having heard foresd Indictmt.read, as also the Examination of these five following Evidences upon their Oaths viz Capt Arnold Elzey. Thomas Poole John:Parsons. Wm Joyles Wm Burch & George: Phebus C also Sworn for Maties And this day viz the 10th :day of Novembr aforesd The Jurors of that Jury returns to the Barr in Court and being perticularly calld by their Names are all unannimously agreed of their Verdict The plts & dft being ____ likewise calld. the verdict is read as followeth ___ Wee of the Jury find that Thomas Porter hath taken up and backt & kept in possession a Gray horse of the value of four hundred pounds of tobacco. Wm:Piper formn The foresd Indictmt. was pr Grand Jury found Billa vera __________________ Which verdict aforesd was pr Court Ordered to be entered. And the Courts judgmt is that the aforesd horse mentioned in the Indictmt belongs to their Maties to whome the fourfold is Ordered provided no other person appear & make just Claime thereof. ______________ Whereupon this Court Orders the Said Thomas Porter to find Security for his good behavior fourfold & fees C Whereupon Came the aforesd Porter and brought for Security Daniel Hast. And the said Porter did acknowledge himself to be indebted to their Maties |
