Whereupon the plt by James Sangster his Attorney Comes & Sayes that the sd Plaintiff
by his receiver Wm:Cord of Mattapony hundred Planter did receive in the year 1691
One hogshead of tobacco weighing neat four hundred & six pounds of tobacco & Marked
WD:N^o: 35, which Said hhd of tobacco So received, marked & weighed. the said Dft hath
fraudulently & Craftily deceived the plt thereof, though the sd plt presumeing upon the
Same had taken fraight therefore. So that the said Tobacco is not Secured for y^e plts use
according to Act of Assembly for Securing of Mer^chts tobaccoes received which said tobacco
the plt hath often demanded of the deft. who hath hitherto denyed Satisfaction and
yett doth Deny to the plts great loss & damage to the value, according to the Said act made
& provided, & hereupon hath brought his Suite &ca.                               Jn^o. Doe

be indebted unto their Maties in the Sum of tenn pounds Sterling money. due to be leavied on
his goods & Chattels Lands & Tennements for their Maties uses &ca. CThe Conditon of the aforsd
Recognizance is Such that if the abovesd Rose Mason doe p^rsonally appear before o^r Justices of
