Seedings fences woods underwoods easements and other the heriditaments priviledges proffitts ~
and other the heriditaments benefitts thereunto belonging or in any wise appertaining (Royall mines excepted)
To have and to hold the Said parcell of Land Called Goldsmiths delight aforesd: & all & Singular ~
other the pr:misses hereby meant mentioned or intended to be bargained & Sold & every of them unto him y Sd:
John Goldsmith his heires and assignes To y only proper use & behoofe of him the Sd: John Goldsmith his heires
& assignes for Ever; without any Mortgage reduction use or Limitation to recall alter Charge or dettermend by
Same the rents & Services due to the Lord or Lords of the ffee alwaies excepted & foreprized as by y Sd: Deed
of Grant at more Large appeares And the Said Capta: Henry Smith for himselfe his heires extectrs
& administratrs: doth for ever freely acquitt & discharge the Sd: parcell of Land Called Goldsmith
Delight of and from all & all manner of formr: & other bargaines grants Sales forfeitures Dowries
Jointures Surrenders & of & from all other Titles incumbrances Claimes & demands whatsoever
And that he the Said Capta: Henry Smith at the Time of the ensealing and delivery of these pr:Sence
is and Standeth Seized of the said Land & premisses (called Goldsmiths delight) untill now of A
firme Sure good and indefeazable estate of inheritance in ffee Simple and that he hath good
right full power and Lawfull Authoritie to grant bargaine & Sell the Same in manner and
forme aforesaid unto him the Said John Goldsmith his heires executors administrators and
assignes for Ever against all persons whatsoever Claiming from by or undr: him the Said Capta: Henry
Smith his heires executors and administrators And the Said Capta: Henry Smith for himselfe
his heires executors admrs: and assignes doth further Covenant to and with the Said John ~
Goldsmith his heires executors administrators and assignes That he the Said Capta: Henry Smith
Shall & will at any tyme hereafter for and duering the Space of Seaven years next ensueing the date
hereof at and upon the reasonable request and only at the Cost & Charges in the Law of him y Sd: John
Goldsmith his heires executors administrators and assignes make doe execute acknowledge & Suffer
or Cause to be done executed acknowledged and Suffered all & every Such further Act and Acts thing
& things device and devices in the Law whatsoever to be done for the better Setling and more perfect
Sure makeing of all & every the bargained pr:misses unto the Said John Goldsmith his hereis executrs:
admrs: or assignes for Ever as Shall be by him the said John Goldsmith his heires executors administratrs:
or assignes or his or theire Councell learned in the Lawes devised and advised or required In Wittnesse
whereof the Sd: Capts: Henry Smith hath hereunto Sett his hand and ffixed his Seale the day and year first

Browne and Captaine Robert King Justices of Peace for Somr:Set County Came Capta:Henry Smith ~
partie to the within written Indenture in his Proper person and did acknowledge the Land in the within
written Indenture to be the right of y within mentioned John Goldsmith as those wch: the said Jno:Goldsmith
hath of y guift of him the Said Capta: Henry Smith for him & his heires and hath remised and made quitt Claime~
thereof unto the Sd: John Goldsmith and his heires for Ever And further the Said Capta: Henry Smith hath
granted for himselfe and his heires the Sd:Land within mentioned called Goldsmiths delight unto him y
Sd: John Goldsmith and his heires agt: him y Sd: Capta: Henry Smith & his heires he will warrant for Ever
& for this acknowledgemt: quitt Claime & agreemt: the Sd: John Goldsmith hath give the Sd: Capta: Henry
Smith eight thousand pounds of tobacco ~ ~ ~ ~ Taken before us ~ ~ ~ ~
