83 This Indenture made the eighteenth day of March in the Sixteenth year of y Dominion of the Rt: honr:ble Charles absolute Lord & Proprietary of the Province of Maryland & Avalon Lord Baron of Baltemore &c And in the year of our Lord god one Thousand Six hundred & Ninety Betweene Thomas Seawell of Somr:Set County in y Province of Maryland plantr: of the - one Part And Mary Curtis of the Said County of Somerset & Province of Maryland of the other Part Wittnesseth That whereas by Pattents under the great Seale used in the Said Province of Maryland for graunting of Land there was graunted three hundred acres of Land Called Boyces Choice unto William Boyce late of this County deceased & one hundred acres Called Hollwell unto the above named Thomas Seawell as records remayning in y Secretaries office at St: Maries recourse being thereunto had more fully & more at Lardge it may and doth appeare the Sd Land being Scituated Lieing & being near the head of Anamessex river in the aforesaid County of Sommerset in the Province of Maryland & now in the Possession & occupacon of the above named Thomas Seawell Now This Indenture further wittnesseth That the above named Thomas ~ Seawell for & in Consideracon of four Thousand pounds & for the yearly rent hereafter mentioned) before y ensealing & delivery hereof hath demised granted & to farme Letten & by these presents hath demised granted & to farme Lett unto the Said Mary Curtis widowe A part or parcell of the aforesaid Land Called Boyces Choice Containing by estimacon one hundred acres more or Less & is now Called the Widowes Mite bounded as ffolloweth beginning upon the Southermost Side of Boyces branch at the fforke of the said branch for length & Soe running east up the Said branch on the Southward Side of it untill it arrive at the out Side bounder & from thence to a red oake yt Standeth on the eastward Side of Robert Catlins branch and from thence runing downe the eastermost Side of the Said branch untill it Come to y first bounder Containing as aforesd by estimacon one hundred acres more or Lesse Together with all & Singular the roomes Sellers halls parlours Chambers houses houseings Courts yards gardens orchards ffences woods underwoods Timber or Timberlike trees waies Easemts: fishing fishing places and other appurtenances & emolu= ments whatsoever unto y said parcell of land Called y widowes mite bounded as aforesaid with free Egress ingresse & regresse way & passage to and for the said Mary Curtiss her heires executrs & administra= tors theire Servants & assignes To have and to hold the Said parcell of Land Called y widowes Mite & all & other the demised or meant mentioned or intended to be demised premises with theire & every of theire rights members & appurtenances unto the Said Mary Curtis her heires & assignes To y only proper use & behoofe of her the Said Mary Curtiss from the day of y date of these presents for & duering the Terme of Ninety and Nine years to be fully Compleated & expired yearly & paying therefore yearly & every year duering the Said tearme of Ninety & Nine years one hen annually if Lawfully demanded unto the Said Thomas Seawell his heires or assignes And the Said Thomas Seawell doth Covenant & grant for himselfe his heires executrs: admrs: & assignes & every of them to and with the Said Mary Curtiss her heires executors: and admrs: & assignes & every of them That he the Said Thomas Seawell nor his heires Shall not nor will not at any time or times hereafter ~ duering the Continewance of this present Lease demise Sell or graunt the pr:misses to any person or persons whatsoever for or duering the terme hereby granted or any part thereof without Licence first had & obtained of the Said Mary Curtiss widow her heires executors or admrs: undr: theire hands & Seales And the Said Thomas Seawell for himselfe his heires executors & admrs: & every of them the Said parcell of Land with y appurtenance before by these presents demised to her the Said Mary Curtiss widow doth freely acquitt & dischardge the Same off and from all & all manner of formr: & other bargaines graunts Sales Leases forfeitures Dowries Joyntures Surrenders & of & from all other Titles incumbrances Claimes & demands whatsoever and that the Said Mary Curtiss her heires or assignes & every of them Shall & may from time to Time and at all Times hereafter duering the Tearme of Ninety Nine years peaceably & quietly have hold occupye Possesse |
