70 within written Indenture in theire proper persons and the Sd: Jane being by the Sd: Justices alone & Secretly examined Did acknowledge the Land within mentioned in the within written Indenture Called the Line Lott to be the right of y within named William Brittingham as those wch: the Sd: William Brittingham hath of y guift of them the said Joseph Staton and Jane his wife and for them and theire heires and the heires of the Said Jane have remised & made quit Claime thereof to the Said William Brittingham and to his heires for Ever And further the Said Joseph Staton and Jane his wife have granted for themselves and for theire heires and all & every the heires of the Sd: Jane that the Sd: Land within mentioned unto him the Sd: William Brittingham and his heires against the Sd: Joseph Staten and Jane his wife and theire heires and all & every the heires of the Sd: Jane will warrant & defend for Ever and for this acknowledgemt. And in the year of our Lord God one Thousand Six hundred and Ninety Betweene Thomas Lydster of Somr:Set County in the Province of Maryland and Abigaile his wife on the one part And Samson Allen of the County & Province aforesaid on the other part Wittnesseth That whereas the Rt. honr:ble Cæcilius absolute Lord & Proprietary of the Province of Maryland & Avalon Lord Baron of Baltemore &c by his Deed of Grant undr: y great Seale used in the Province of Maryland for granting of Land there bearing date the eight day of ffebruary in y Nine & thirtieth year of the Dominion of the Sd: Lord Baltemore over Maryland &c Annoq Dom: 1670 Did for the Consideration therein mentioned Grant unto Maurice Lister of the County & Province aforesaid A Tract or parcell of Land Called by the name of Morris Hope Scituate Lieing & being in Somr:Sett County aforesaid on the Eastearne Shore upon a bay Comonly knowne by the Name of Pocomoke bay Side Southerly for bredth on the North Side of the Said bay bounded as ffolloweth beginning at a marked white oake Standing by the Side of Pocomoke bay & running along the Sd bay Side Southerly for bredth to a parcl of land Surveyed for Jenckin Price & from thence running into y woods north west for length by the Said Jenckin Price his Land & bounded therewith five hundred (thi)rty four poles to a marked oake & from thence Seaventy poles northwest to a marked Tree & from thence with a Line drawne Southwest five hundred thirty four perches to y first bounder Containing Two hundred & fifty acres more or Less To have & to hold the (said) Tract or parcell of Land to him the Said Maurice Lister his heires & assignes for Ever undr: Such rents Covenants Limitacons & exceptions as in & by the Said Deed of grant recourse being thereunto had more fully & more at Large if may & doth appear by wch device the Said Morris Lister became possessed of an estate in fee simple in the Said Land And Since the Said grant vizt on the 12th: day of March in y Second year of the Dominion of the Rt: honr:ble Charles over Maryland &c Annoq Dom: 1670 the Said Maurice Lister by his Certaine Deed of Indenture duly executed & enrolled Did |
