( 209 ) I John Orr doe hereby declare what I herd & Sie Conserning the for sd accident the forsd mr Wilcock being abord of our ship the for sd Rott: Hunter offred to goe allong with him and our Bosson replayed, that it was a -- discomendable thing to offer to leave the ship So they fell a quarelling & I went upon deck & presentlie & heirs Som Say that Rott: Hunter & the Bosson was fightin whereupon I went down & tock Rott: Hunter in my armes off the Bosson with much adoe So Rott Hunter fell upon me & I sayes to him good Rott be Sevill & mack no more off it otherwayes if you will not be quaitt I will medell no more with you the I went to deck & did own him no more this is all that I sie concerning the forsd accident to the best of my knowledge, untill I sie him laying dead I know no malise or envy that either mr Cruckanks or Rott: Hunter had to one another allong the voage -- his John: J O . Orr. marke. The abovesd Deposition was Read in Court, to the truth of which ye Deponent. Com to the Deck, with Sword and begnet in his hands, then Rott: Hunter, Sieing the armes went to the boot & gott a hatchett So mr Cruckshanks Stood Still & Spoke not a word to ane man, then Rott: Hunter Comes to him and Sayes man does thou think that I am affrayed of my life & whither or nott he struck or pushed att with the hatchet at mr Cruckshanks & can not tell butt mr Cruckshanks fell bacward att ye Stireg dore & I fled out of the way & Sie no more till I sie the dead. John: Bart, The abovesd Deposition was read in Court, to the truth of which the Deponent made Oath too . ----- ____ The afore Justices having inspected into the premises doe find cause of Comittmt. And therefore doe Order the Sheriffe of our County to take into his Custody the foresd Andrew: Cruckshanks, and him in Saif Custody keep So that he have his body before the Justices at the next Provincial Court to be holden at the Citty of St. Maries then & their to answer to what shall be Objected agt him the sd Cruckshanks on Maties behalf Concerning the death of Robert: Hunter _____ The Court likewise Ordered that John: Boutin, Mate to the said Cruckshanks, should give Bond for him Self & the rest of the ships Company to appear at the foresd Provincial Court to give in their Evidence on behalf of their Maties agt the sd Andrew: Cruckshanks. _____ - - - - - _______ - - - - - - ____ And the said John: Boutin did this day being the 18th: day of April Anno Dom 1692. in Court by way of Recognizance aknowledge and Confess him Self to be justly indebted to their Maties King William & Queen Mary the just Sum of One hundred pounds Sterling money of England, due to be leavied on his goods & Chattels for their Maties uses &ca. The Condicon of which Recognizance is Such that if the above bound John: Boutin Alexander: Davidson. Wm Rid, John: Brown, Wm. Gwilliland. John: Paterson, John: Orr & John: Bart. doe make their personal appearance at the next Provincial Court to be holden at the Citty of St. Maries, to give in their Evidence for their Maties agt Andrew Cruckshanks, then the Recognizance to be voyd & of none effect otherwayes to be & remaine in full power force & vertue
