March 12th. 1691/2 ( 194 ) - - - - - - - Mr James: Round Plt Somerset County Sc. Matthew: Scarbrough of this County Contra: } Gent was attached to answer unto James Round of ye Same Matt: Scarbrough Dft County Gent. Attorney of Mosech Aboab of New York in a plea of debt - - - - - - - - - - And whereupon the plt by his Attorney James Sangster. Comes and Sayes that the said Defendant by a Certain Instrument under the hand and Seal of him the Said Defendt bearing date ye Sixth day of ffebruary Anno Domi 1690/1: Became bound and Stood indebted unto the said Mosech Aboab his Heirs Execcutors Admrs or Assigns, Two good Sufficient Cowes and Calves, wherein the said Defendt did bind him Self his Heirs Execcrs & Admrs to deliver the said Cows and Calves at the dwelling Plantation of the sd dft at or upon ye first Day of may: next & Immediat after ye Date of ye Sd Instrument: as by ye Same it Doth and may more plainly appear and is here in Court produced yet he ye Sd Dft fraudulently & Craftyly Intending to Deceive ye plt of ye foresd two Cowes & Calves hath hitherto Deneyed paymt and yet Doth Deney to ye plt great loss & Damage to ye value of four Cowes & Calves and hereupon brings this Suit &c. - - - - - - - - - - ____ - - - - ___ - - - {John: Doe Ja: Sangster pr Qur pled prs Rich Roe } Know all men by these presents yt I Mosseh Aboab of new York have made Ordained Constituted and by these presents Do make ordaine Constitute & appoint my most respected friend mr James Round of Somersett County in ye province of maryland Gent: my true & lawfull attorney for me & In my name and for my use to aske & Demand and Receive of mr Matthew Scarbrough a certaine Bill past by ye Sd Scarbrough for two Cowes & Calfe payable to me by ye first Day of may next Ensuing ye Date hereof & bearing Date ye Sixth Day of ffebry Anno 1690/91 & if fauld of not payment there of to Sue and proceed to Judgmt. & Execcution & thereupon in prison to hold & keep till paymt. be made with all Cost & Damages and upon paymt. thereof forth of prison to Discharge & acquittance for ye Same given by these presents all my whole power and Authority to ye Sd my Attorney as if I Should be there prSonally present In Wittness Whereof I here Sett my hand & Seale in Mary- land this Seaven Day of ffebrrs. 1690/91 Mosseh Aboab Sealed Signed Sealed & Deliver in presence of us Wm Turvill Johnathen Towers Know all men by these presents that I Matthew Scarbrough of Somerset County of Marryland Confess my Self to stand firmly and to Mosech: Aboab. of New York his Heirs Execcutors Admrs. or Assigns, Two good Sufficient Cowes & Calves not under four years old and not above Seaven years old at or upon the first day of May Next ensueing the date hereof to be delivered at his own Plantation to which Certain payment, well and truly to be made by me.
