March 11th. 1691/2 /Same Comrs. asd. ( 188 ) - - - - - - - - - - - - - - Their Maties Somerset County Sc The Jurers for their Maties being Sworn upon ye Contra: } holy Evangelists at a grand Jury held for the body of this County ye Second Thomas: Porter. Tuesday in Novemr last past doe present and find that Thomas Porter of this - - - - - - - - County Planter not having the fear of God before his Eyes nor Regarding the good laws and institutions of this their Maties Province, upon the twenty fifth day of July Ao. Dom 1691 did most wickedly and felloniously at hogg neck, within the Jurisdiction of this Court Steal and Carry away three black Boar piggs off and from the Sows belonging to mr ffrancis: Jenckins, of the value of One hundred & fifty pounds of tobacco. To the great Scandall, Evil Example and damage, and detriment, not only of the sd mr ffrancis Jenckins, but also of the good people and inhabitants of this Province, Contrary to ye Laws, and agt the publick peace, Their Maties Attorney Craves judgment may be entered against the said Thomas Porter, according to Law in that Case made and provided &ca. James: Sangster Clr Indtmts. The plts and dft being Calld the foresd Indictmt. was read to which the said dft pleaded not guilty and for tryall was referred pr Court to a Jury ______ - - - - - Whereupon Comand was given to the Sheriffe to bring here into Court twelve good and lawfull men of his Balywick that the matter in hand might be the better known a list or pannel whereof are returned being legally Sumoned, and Sworn upon the holy Evangelists. whose names are as appears upon the left hand. who having heard the foresd Indictmt Jurors names viz, as also the Oaths of three Evidences bondes the examination of three more Henry: Hall. with these Depositions following. viz _____ - - - - - - - _______ Walter Talbott October ye 19th. 1691. Then Came before me William: Layton & Cornelius Edward: Evins. Anderson & did depose that William: Burch & Thomas: Porter had Some words John: Colhoone. of difference, which difference Porter desired to agree & End it and did Say yt William:Porter if Burch would Comply he would at his own trouble gett Coll. David Browne Roger: Burkum. and mr James: Dashiels to come to his Brother John: Hollands for to end ye difference James: Ingram. John: Winder. - - - - - - - the marke of Joseph: Bainton. Cornelius Anderson John: Browne. his marke Thomas: Tull. William Layton. Thomas: Smith. Robert: Polk. Evidences Sworne.viz And this day having asd heard the totall proceedings the sd Wm. Burch. Jury as in the Margent or left hand after the Charge given, are Sent forth to Cornelius Anderson determine the matter ______ - - - - - Which Said Jury being returned Wm. Layton. in Court, being each man Calld Over by their names are all unanimously agreed Evidences Examined of their verdict, the plts & deft first calld. the verdict is read as followeth - Hen: ffreaks Wee of the Jury do find Tho: Porter not guilty of this Indictmt. Hen: Hall forem. Tho: Rolph & Tho: Horseman. - - - - - - - - - - - - This Court Orders the verdict to be entered. Ordered likewise sd Porter pay the Jurors fees. Ordered likewise the said Porter give Security for his good behaviour dureing this Courts pleasure and for Cost of Suit.whereupon Came the sd Porter & his 2.Securts. viz Wm:Elgate & Tho:Horsman. and ye sd Porter did acknowledge himself to be indebted to their Maties in the Sum of 10£:Sterl.& his Securities in y Sum of 5£.Sterl.a piece to be levied on their good & chattels lands & tennements for their Maties uses &c = The Condicon &ca is that ye sd Porter shall be of y good behaviour dureing pleasure &ca.
