( 189 ) March ye 11th. 1691/2 . Their Maties - - - - - - - - - - - Contra } Somerset Sc. The Jurors for their Maties being Sworn upon the holy Daniel: Selby Evangelists at a Grand Jury held for the body of this County the Second - - - - - - - - Tuesday in Novemr last past doe present and find that Daniel: Selby of Mattapony hundred and within the Jurisdiction of this Court Sometime Last Spring, did pack up and picle, a Certain lean Carrion Cow, which of poverty died in his own field at the said plantation in the Said hundred, and the Same did pay away for Mertable beef, and thereby did Cheat and Cozne the Merchant, which said Cheat was not only injurious to the private Interest of the buyer, but also to the publick trade and Comerce of the Country and agt the Laws of the Land Their Maties Attorney Craves judgment agt the said Daniel: Selby according to Law, in that Case made & provided. - - - - - - - - - James: Sangster. ____ - - - - - - _____ The Indictment being read, to which the sd Selby pleaded not guilty. and this Court refers the tryall to a Jury: ___ Whereupon Command was this day given to the sheriffe to bring here twelve good and Lawfull men of his Balywick that the matter might be the better known. A list or pannel whereof are upon the left hand, who being legally returned Sumoned & Sworn upon the holy Evangelists having heard Henry: Hall. the aforesaid Declaration, as also the Oaths of the Evidences fairly examined viz of Walter: Talbott mr John: Cornish & mr James Sangster & Walter Read. James Maynard was Sumoned Edward: Evins. & examined but not Sworne. which sd Jury as in the Margent having deliberatly heard John: Colhoone. the totall proceedings receives their Charge and are Sent forth in Order to determine ye same Wm. Porter., Roger: Burkum. James Ingram And the Same day as abovesd the aforesaid Jury returns in Court, being Joseph:Bainton each man perticuliarly calld overby his name, being asked, are all unanimously John: Browne. agreed of ther verdict. the plts and deft being calld. sd verdict is read Thomas: Tull. as followeth: Wee of the Jury doe find find that Daniel: Selby is not Thomas:Smith. guilty of the Indictment. Henry: Hall. foreman . ______ - - - - _____ Robert: Polke 12 - - - - - - - - - - This Court Orders The verdict to be entered.
