The Said Margarett hath most felloniously Stolne as Said is. To the great Scandall Evil example of
others, and against the publick peace. Their Maties Attorney Craves judgment may be entered agt the said
Margeret Kenneday according to Law in that Case made and provided, and that she Suffer the pains
and punishments by law thereupon inflicted . ______ James Sangster Clr. Indtmts




The aforesd Indictment being Read, to which the said Margerett Kenneday pleaded not guilty
and for tryall put her Self upon the Country, whereupon Comand was given to the sheriffe to bring
here twelve good and lawfull men of his Balywick that the matter in hand might be the better known
a List or pannel whereof are thus returned as appear in the Margent, being leagally Sumoned, returnd
and Sworn upon the holy Evangelists having heard the forsad Indictment read, as also Six Evidences
Sworn and examined, receives their Charge and are Sent forth to determine the Same. _____ - - - - -
Jurors viz This following Deposition was likewise read, as followeth viz
Henry: Hall: The Deposition of Samll . Hopkins Senr. this Deponent Saith that being at dinner alias
Walter Talbott Supper in the house of mr. Andrew Whittington, as the Deponent remembers at August Court
Edward: Evins last past) word was brought the Deponent, that Margeret: Kenneday would Speak with him
John: Colhoone this Deponent imediately went forth to know the said Kennedays business. she came to ye
William: Porter Deponent and gave him ye relation following, to witt that she now Saw she was a fool for
Roger:Burkum. not telling the truth about the hoggs. This Deponent told her that if she had concealed
James Ingram. the truth by lying she was a fool indeed, or to that effect, she replyed, though I denyed
Joseph: Bainton. the killing of the hoggs at ye house, yet I alwayes resolved to declare it when I came
John: Browne to Court. and yw may remember I told yw I had more to say when I came there, then I
Thomas: Tull. would speak at that time, Referring as the Deponent understood, to her examination at
Thomas: Smith my house, she added further, that Seeing the Court was broke up, and there Could be no tryall
Robert: Polke 12 now she had Sent for me to declare the truth to me, though she knew she must be whipt
- - - - - - - - - - - - she then uttered these words (viz) the hoggs we killed were of three marks, I asked her what
Evidences hoggs, those that Betty Lawrence had Sworn too, I asked if she owned that she helped or
John: Pope. asisted in killing those hoggs, she answered yes, like a fool as I was, & I have undone my Selfe
Robert.Johnson I asked her if she owned what Elizabeth Lawrence had made Oath of at my house she answered
Eliz. Lawrence Betty has Sworn nothing but the truth. Betty replyed, yw know Margeret I told not a word of a lye
John: Tarr. neither of yw nor my Mistress nor no body else. Margaret answered no more you did Betty. I asked
mr Samll.Hopkins if she know whose hoggs they were that they killed, she answered she did not Certainly know, but
Martin Troutam. Some of them they Said was Thomas Oxfords hoggs, then she nominated & described all three of y

markes, which she related as abovesd, and promised to declared them the next Court this & more to the Same purpose she very
freely & very fullently declared to the truth of all above written the deponent Can Saifly be deposed witness my hand . _____
Courts adjourned for a quarter of an hour. Samuel: Hopkins _______
And this day to witt the 9th: day of March Anno Domini 1691/2 the aforesd Jury as in ye Margent Comes
in Court ye plt & dft being calld as also the Jurors of that Jury, and being all agreed of their verdict
which is read as followeteh. viz. Wee of the Jury do find Margeret Kenneday guilty of the Indictment & do valued the hoggs at 800lb
